A certain document, three copies of which are on file in the office of the Secretary of the Borough of Kittanning, being marked and designated as the International Property Maintenance Code, 2006 edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Kittanning, in the Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupancy and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough of Kittanning are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 422-8 of this article.

106.4 Violation penalties. Any person who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, is guilty of a summary offense, punishable by a fine of not less than $100 and not more than $1,000. Each day that a violation continues after due notice has been served shall be deemed a separate offense. |

A.
Notice of violation. Upon the determination that there exists a violation of the Property Maintenance Code by the Codes Enforcement Officer of the Borough of Kittanning, or any other such officer or agent of the Borough of Kittanning as may be designated from time to time by resolution (hereinafter, collectively "CEO"), the CEO shall give written notice to the owner of the property as listed on the tax assessment ownership rolls of Armstrong County, to the occupant of the property, and to the owner of the property at such other address actually known by the CEO.
B.
Contents of notice. The written notice shall contain, at a minimum, a detailed description of the violation of the Property Maintenance Code existing and the timeframe for correction of said violation
C.
Time for correction, initial notice. The initial notice of violation issued by the CEO shall provide a time period within which the described violations must be corrected. The time period shall be based upon the season and weather conditions and the nature of the violation. In no instance shall the timeframe be less than 21 calendar days.
D.
Initial violation. If the violation is not corrected as set forth in the initial notice, the property owner shall be subject to a fine of $50.
E.
Violation not corrected as set forth in initial notice. If the violation is not corrected as set forth in the initial notice, the CEO shall issue a second and final notice, providing an additional corrective action time frame of not less than 15 days nor more than 30 days.
F.
Violation remaining after second notice. If the violation is not corrected as set forth in the second and final notice, the property owner shall be subject to a fine of $500, plus the costs of prosecution.
G.
Repealer and ratification. All ordinances or portions of ordinances inconsistent herewith are hereby repealed. All parts of ordinances related to the Property Maintenance Code not amended hereby are ratified.
Ordinance No. 404-1999 of the Borough of Kittanning entitled "An Ordinance of Kittanning Borough, Armstrong County, Pennsylvania Establishing the Minimum Regulations Governing the Conditions and Maintenance of All Property, Buildings and Structures by Providing the Standards for Supplied Utilities and Facilities and Other Physical Things and Conditions Essential to Insure that Structures are Safe, Sanitary and Fit for Occupation and Use, and the Condemnation of Buildings and Structures Unfit for Human Occupancy and Use and the Demolition of Such Structures, Which Ordinance Shall Hereafter be Known as the Property Maintenance Code" and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
