This chapter prescribes an alternate means of proceeding against persons in violation of the following Borough ordinances, and any amendments thereto, whether the amendments are set forth below or not:

The Codes Officer of Kittanning Borough may, in his sole discretion, assess a financial penalty directly against a person violating an ordinance set forth in § 32-1, above, in lieu of proceeding against such person in a summary proceeding before a Magisterial District Judge.

If the Codes Officer elects to proceed in the manner provided for in § 32-2, above, the officer shall deliver to the offender a written notice of violation. The notice of violation shall set forth the Codes Officer's name, address and telephone number, the specific ordinance being violated, and where necessary a concise statement of the nature of the violation.

The notice of violation shall set forth the following monetary penalties, which shall increase with the passage of time: a penalty of $25 if paid within five calendar days of the violation; an additional daily penalty of $5 per day to accrue on days six through 10; an additional penalty of $10 on day 11; an additional daily penalty of $5 per day to accrue on days 12 through 16; and an additional penalty of $15 on day 17. The payments provided for herein shall be made at the Kittanning Borough Office.
If the offender pays the monetary penalty within the prescribed time period, then the Codes Officer shall not initiate summary proceedings for that violation. If, however, the violation is of a continuing nature and continues beyond the prescribed time period, the Codes Officer may assess additional financial penalties as provided herein for as long as the violation continues, or the Codes Officer may initiate summary proceedings for the continuing violation.
The Borough shall provide the Codes Officer with acceptable written notices of violation in order to proceed under this chapter. The original notice of violation shall be given to the person in violation, and copies of each notices of violation shall be retained by the Codes Officer and the Borough Secretary.
