No child 17 years and under the age of 17 years shall be upon
any of the public streets, highways, alleys or other public places
of the Township of Cecil unless such child is accompanied by his or
her parent, guardian or other person having the legal care or custody
of such child, or is accompanied by a responsible person over 18 years
of age, or is in the performance of an errand or duty directed by
his or her parent, guardian or legal custodian, or whose, legal, recognized
employment makes it necessary for such child to be in or upon said
public streets, highways, alleys or other public places between the
hours of 9:30 p.m. and 5:00 a.m. on weekdays and 10:30 p.m. and 5:00
a.m. on Saturdays, Sundays and holidays; during the school vacation
in summer, the hours shall be 10:30 p.m. to 5:00 a.m.

No parent, guardian or other person having the legal care or
custody of a child 17 years of age or under 17 years of age shall
allow or permit any such child to go or be in or upon any of the public
streets, highways, alleys or other public places of the Township of
Cecil between the hours of 9:30 p.m. and 5:00 a.m. on weekdays and
10:30 p.m. and 5:00 a.m. on Saturdays, Sundays and holidays, provided
that, during the school vacation in summer, the hours shall be 10:30
p.m. and 5:00 a.m., unless reasonable necessity can be shown therefor.
The policemen of the Township of Cecil, upon finding a child
under the age of 17 years in or upon any of the public streets, highways,
alleys or other public places of the Township of Cecil in violation
of any of the provisions of this chapter between the hours specified
herein shall take the name of such child and the name and address
of the parent, guardian or other person having the legal care or custody
of such child, and shall take the child to the parent, guardian or
legal custodian, subject to the right of arrest of the minor as hereinafter
set forth, and make report of the same to the Chief of Police within
24 hours.
Any child who shall violate this chapter more than two times shall be reported to a society or organization the purpose of which is to take charge of incorrigibles and delinquents, and proceedings shall then be taken in the Court of Common Pleas or Juvenile Court for the permanent welfare of such child, and a like procedure shall be taken in cases where the arrest of the parent, guardian or legal custodian shall not be effective, or where for any other reason the provisions of § 95-1 of this chapter cannot be made effective by fines and penalties imposed under any other section of this chapter.
The police officers of the Township, in taking children into
custody under this chapter, shall use their discretion in determining
age, and in doubtful cases may require positive proof and, until such
proof is furnished, the officer's judgment shall prevail.

Any person, firm or corporation who shall violate any provision
of this chapter, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this chapter continues
or each section of this chapter which shall be found to have been
violated shall constitute a separate offense.
