No person having possession, custody or control of any animals shall knowingly or negligently permit any dog or other animal to defecate upon any gutter, street, driveway, alley, curbs or sidewalk in Kittanning Borough, or upon the floors or stairways of any building or place frequented by the public or used in common by tenants, or upon walkways, driveways, alleys, curbs or stairways of any building abutting on a public street or park, or upon the grounds of any public park or public area, or upon any private property other than the property of the owner of such animal.
Any person having possession, custody or control of any dog or other animal which defecates on any property, as set forth in § 258-15 hereinabove, shall be required to immediately remove any feces from such surface and either:
A. 
Carry same away for disposal in a toilet; or
B. 
Place the same in a nonleaking container for deposit in a trash or litter receptacle.

No owner or possessor of real property shall permit animal fecal matter to accumulate on such property for more than 24 hours, and it shall be the owner's or possessor's responsibility to daily remove such matter to prevent any such accumulation from becoming a danger to public health. Nothing in this section shall be deemed to relieve persons walking their dog or other animal from the duty to immediately dispose of their animal's feces pursuant to § 258-16 of this article.
Any person, firm or corporation who violates any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, or to imprisonment for a term not to exceed 90 days.
