In the JM Jericho Mountain District, the following regulations shall apply:
A.
Use Regulations. A building may be erected or altered, to be used either in whole or in part, and a lot may be used or occupied for any of the following uses, and no other, provided that such uses shall comply with such regulations as yard, lot size, lot width, building area and height, impervious surfaces, easements, buffer yards, off-street parking, and other provisions as are specified in other Articles herein.

Use by Right. Any of the following uses shall be permitted, provided the Use Regulations, Article VIII, of this Ordinance, have also been met:
a.
Agriculture and Horticulture, use A-1.
b.
Forestry, use A-3.
c.
Single-Family Detached Dwelling, use B-1.
d.
Single-Family Detached Cluster, use B-12.
e.
Residential Accessory Structure, use H-3.
f.
Temporary Structure, use H-7.
g.
Swimming Pool, use H-8.
h.
Microwave Antenna for Television Receiving only Satellite Earth Stations, use H-12.
i.
No-Impact Home-Based Business, Use-H2.
j.
Use H-19, Accessory Solar Energy Equipment.

Uses by Conditional Approval. Any of the following uses shall be considered permitted, provided the conditions for conditional use approval have been met in accordance with Article XIII, in addition to the Use Regulations, Article VIII, of this Ordinance:

Signs shall be permitted in accordance with Article XI.
B.
Table of Performance Regulations. All regulations must be met. These regulations may be less strict than other performance standards in Article IX, Environmental Performance Standards, but the strictest regulations shall govern.

D.
Regulations Applying Throughout the District. No building shall be placed in any of the following areas:
1.
Slopes in excess of 15% except by special exception provided that the standards and conditions in § 903.B.4. are met;
2.
Within any Identified Floodplain Area as defined within the Floodplain Ordinance of each respective municipality;

3.
Within 50 feet of the centerline of any stream, creek, river, or other water course where the average slope of the ground to the stream is greater than 8% and less than 15%, or within 100 feet of the centerline of the stream where the average slope of the ground is more than 15%; or
4.
On wooded lots: In addition to the regulations for Trees on Wooded Lots, § 903.B.6, herein, the following shall apply:
a.
The intent of this Section is to insure that the minimum number of trees be removed. This applies specifically to the edge of the ridge and the steep slopes of the mountain in order to minimize the potential for soil erosion and to maintain an uninterrupted mass of vegetation as viewed from the valley below. Therefore, no live tree of caliper greater than 10 inches measured at a point four feet above grade shall be removed in connection with a land development or building permit unless a zoning permit for a specific number of trees in a specific location is first obtained from the municipal zoning officer upon recommendation by the local planning commission. Permits will be granted only where tree removal will not adversely affect the intent of this Section or the utility and character of the overall foliage of the parcel or lot in question.
b.
In no case will removal of trees exceed the standards for steep slopes or woodland protection within §§ 903.B.4 and 5.
c.
The permit provisions of this Section shall not apply to a landowner who wishes to remove an individual tree not in conjunction with a land development or building permit.
E.
Open Space Regulations for Single-Family Cluster Developments.
1.
All such open space shall consist of a lot or lots restricted against further subdivision and restricted against further development other than structures permitted in open space.
3.
Structures within the open space may include, but are not limited to, swimming pools, tennis courts, and other structures serving the uses set forth herein, subject to the provision that no more than 5% of the open space shall be covered by structures or paved by an impervious surface.
