It shall be unlawful within North Lebanon Township for any person or persons to own, possess, harbor or control any animal which engages in conduct constituting a nuisance. Nuisance shall be defined as any act engaged in by an animal digging into flower beds, lawns, children's sandboxes, gardens, or the dispensing of feces or urine and/or otherwise damaging shrubbery, trees or lawns, on premises or property not belonging to the person owning, possessing, harboring or controlling the animal.

The provisions of Subsection 1 of this section, shall include the feeding of stray animals or any other feral domestic animals, small animals, or wild animals that are not kept as household pets, except that feeding cats as part of a recognized trap-neuter-return ("TNR") program in conjunction with a local organization or veterinary practice shall be permitted and shall not be deemed a nuisance.

Any person who violates or permits a violation of this provision of the Code of Ordinances of North Lebanon Township shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 nor more than $600, and/or to be imprisoned for a period not exceeding 90 days. A separate offense shall arise for each day or portion thereof in which the violation is found to exist.
