The purpose and intent of this Part is to ensure that contractors
that perform home improvement contracts in the Borough are registered
with the Commonwealth of Pennsylvania as required by state law, and
therefore maintain liability insurance as required by the Commonwealth
of Pennsylvania.

The terms "contractor" and "home improvement contract" as used
in this Part shall have the same definitions as those terms have in
the Pennsylvania Home Improvement Consumer Protection Act, Act of
October 17, 2008, P.L. 1645, No. 132, as amended, 73 P.S. § 517.1
et seq.

All contractors that seek to perform home improvement contracts
in the Borough shall, prior to receiving a building or other permit
from the Code Enforcement Department for any home improvement contract
in the Borough, provide a copy of certificate from the Office of the
Attorney General to the Code Enforcement Department showing that said
contractor is registered with the Commonwealth of Pennsylvania as
required by the Act of October 17, 2008, P.L. 1645, No. 132, as amended,
known as the Home Improvement Consumer Protection Act, 73 P.S. § 517.1
et seq. Contractors are also required to provide a copy of certificate
upon request from the Code Enforcement Department if a permit is not
required but contractor is performing a home improvement contract
in the Borough. No contractor performing a home improvement contract
in the Borough shall be required to register with the Borough, obtain
a license from the Borough or pay a fee to the Borough to meet the
requirements of this Part.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $100 nor more than
$1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 90 days. Each day that a violation
of this Part continues or each section of this Part which shall be
found to have been violated shall constitute a separate offense.
