Every owner of property within the Borough of Morton shall install
and maintain at least one carbon monoxide detector, either battery
or electrically operated, on every floor used for human habitation
in every building by not later than July 1, 2009.

Every owner of an apartment or townhouse shall install and maintain
at least one carbon monoxide detector, either battery or electrically
operated, in each apartment or townhouse. The device shall be installed
either at the termination of the present lease or by, July 1, 2009,
whichever date is earlier. The Building Inspector shall not issue
an occupancy permit until it has been verified, upon inspection, that
a carbon monoxide detector has been installed and in working condition
in a proper location within said apartment or townhouse.

Every owner of a building used for commercial or business purposes
shall install and maintain at least one carbon monoxide detector on
the premises, not later than July 1, 2009.

All new buildings constructed in the Borough after the enactment
date of this Part shall have at least one carbon monoxide detector,
either battery or electrically operated, on every floor used for human
habitation, installed prior to occupancy.

The Fire Marshal shall be available for advice and to aid the
property owners in the proper installation of the above-mentioned
devices.

The Fire Marshal may inspect the installation of the devices
required by this Part after due and timely notice of not less than
24 hours has been delivered to the property owner.

Any person failing to comply with this Part, upon conviction
thereof in an action brought before a magisterial district judge in
the manner provided for the enforcement of summary offenses under
the Pennsylvania Rules of Criminal Procedure, shall be sentenced to
pay a fine of not more than $1,000 plus costs together with reasonable
attorney fees and, in default of payment of said fine and costs, to
a term of imprisonment not to exceed 90 days. Each day that a violation
of this Part continues or each section of this Part which shall be
found to have been violated shall constitute a separate offense.
