A certain document, a copy of which is on file in the office of the Borough Secretary of the Borough of Morton, being marked and designated as the International Fire Code, 2012 edition, as published by the International Code Council, be and is hereby adopted as the Fire Code of the Borough of Morton, in the Commonwealth of Pennsylvania regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Borough Secretary of the Borough of Morton are hereby referred to, adopted, and made a part hereof, as if fully set out in this Part, with the additions, insertions, deletions and changes, if any, prescribed in §
5-502 of this Part.

1. The following sections are hereby revised:
A. § 101.1. Title. These regulations shall be
known as the Fire Code of the Borough of Morton, hereinafter referred
to as "this code."
B. § 109.4. Penalty. Persons who shall violate
a provision of this code or shall fail to comply with any of the requirements
thereof or who shall erect, install, alter, repair or do work in violation
of the approved construction documents or directive of the Morton
Borough Fire Marshal, or of a permit or certificate used under provisions
of this code, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
together with reasonable attorney fees and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 90
days. Each day that a violation of this Part continues or each section
of this Part which shall be found to have been violated shall constitute
a separate offense.
C. § 111.4. Penalty. Any person who shall continue
any work after having been served with a stop work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $300 nor more than
$1,000 plus costs together with reasonable attorney fees and, in default
of payment of said fine and costs, to a term of imprisonment not to
exceed 90 days. Each day that a violation of this Part continues or
each section of this Part which shall be found to have been violated
shall constitute a separate offense.
D. § 308.1.4. Open-flame cooking devices. "Exception
1. One- and two-family dwellings" is hereby stricken such that it
shall be prohibited to operate charcoal burners and other open-flame
cooking devices on combustible balconies or within 10 feet (3,048
mm) of combustible construction at one- and two-family dwellings in
the Borough of Morton.

1. The geographic limits referred to in certain sections of the 2012
International Fire Code are hereby established as follows:
A. § 5704.2.9.6.1. Locations where above-ground tanks
are prohibited. Storage of Class I and Class II liquids in
above-ground tanks outside of buildings is prohibited within the limits
established by law as the limits within the Borough of Morton.
B. § 5706.2.4.4. Locations where above-ground tanks
are prohibited. Storage of Class I and II liquids in above-ground
tanks is prohibited within the limits established by law as the limits
within the Borough of Morton.
C. § 5806.2. Limitations. Storage of flammable
cryogenic fluids in stationary containers outside of buildings is
prohibited within the limits established by law as the limits within
the Borough of Morton.
D. § 6104.2. Maximum capacity within established limits. Within the limits established by law restricting the storage of
liquefied petroleum gas for the protection of heavily populated or
congested areas, the aggregate capacity of any one installation shall
not exceed a water capacity of 2,000 gallons (7570 L).

Nothing in this Part or in the Fire Code hereby adopted shall
be construed to affect any suit or proceeding impending in any court,
or any rights acquired, or liability incurred, or any cause or causes
of action acquired or existing, under any act or ordinance hereby;
nor shall any just or legal right or remedy of any character be lost,
impaired or affected by this Part.
