The Board of Supervisors may, from time to time, amend, supplement, change, modify or repeal this chapter, including the Zoning Map, by proceeding in the manner prescribed in this Part.

Before voting on the enactment of an amendment to this chapter, the Board of Supervisors shall, by resolution adopted at a stated or special meeting, fix the time and place of a public hearing on the proposed amendment which hearing shall be held pursuant to public notice. In addition, if the proposed amendment involves a zoning map change, notice of the said public hearing shall be conspicuously posted by the Zoning Officer at points along the perimeter of the tract sufficient to notify potentially interested citizens. Such posting shall be accomplished at least one week prior to the date of the hearing.

All proposed amendments shall be submitted for review in the Chester County Planning Commission at least 30 days prior to the public hearing and, in the case of amendments other than those prepared by the Township Planning Commission, shall be submitted to the Township Planning Commission for review at least 30 days prior to the hearing.

Within 30 days following enactment, a copy of the amendatory ordinance shall be forwarded to the Chester County Planning Commission.

Public notice of the proposed amendment shall include reference to the place within the Township where copies of the proposed amendatory ordinance may be examined; shall include either the full text of the amendatory ordinance or the title and a brief summary prepared by the Township Solicitor setting forth all of the provisions in reasonable detail; and shall be published in a newspaper or general circulation in the Township at least once not more than 60 days nor less than seven days prior to enactment.

If the full text of the amendatory ordinance is not including in the advertised notice, a copy of the full text shall be supplied by the Township Secretary or Township Solicitor to a newspaper or general circulation in the Township and an attested copy of the proposed amendatory ordinance shall be filed by the Township Secretary or Township Solicitor with the Chester County Law Library.

In the event substantial amendments are made to the proposed amendatory ordinance, the ordinance shall be readvertised no less than 10 days prior to enactment.

Whenever the owners of 50% or more of the area in any District shall present to the Board of Supervisors a petition duly signed and acknowledged, requesting an amendment, supplement, change, modification or repeal of any of the regulations or restrictions prescribed by this chapter for their District, it shall be the duty of the Board of Supervisors to hold a public hearing thereon and cause notice thereof to be given in the manner prescribed in ยงย 27-2002, above.

In case of a protest against any proposed amendment, supplement, change modification or repeal, signed by the owners of 20%, or more, either of the area of the lots included in such proposed change or of those immediately adjacent in the rear, or in front, or to either side thereof, extending 100 feet therefrom, such amendment shall not become effective except by favorable vote of a majority of the Board of Supervisors.

The Board of Supervisors may refer each petition or proposal for change or amendment, whether under this Part or under another Part to the Planning Commission which shall consider whether or not such proposed change or amendment would be, in the view of the Commission, consistent with and desirable in furtherance of the Comprehensive Plan upon which this chapter is based, as the same may be modified from time to time. The Commission shall transmit its conclusion thereon, together with its reasons therefore, to the Board of Supervisors. The Board of Supervisors shall take such conclusion and reasons into consideration in reaching its decision, but shall not bound thereby.
