No person, co-partnership, association, or corporation may sell, expose or offer for sale, discharge or fire, use, set off or explode, or ignite any display fireworks within the Township except with full compliance of those regulations contained within the laws of the Commonwealth of Pennsylvania as specifically stated at 3 Pa. C.S.A. § 1101 et seq., and said display fireworks shall be defined and identified as stated in the foregoing statutes.

No person, co-partnership, association or corporation may from the date of the passage of this Part sell, expose or offer for sale, discharge or fire, use, set off or explode and/or ignite any consumer fireworks, as "consumer fireworks" is defined at 3 Pa.C.S.A. § 1101 et seq., except as permitted by the state regulations contained in 3 Pa.C.S.A. § 1101 et seq.

The Township may in accordance with 3 Pa.C.S.A. § 1106 enact conditions, prohibitions and limitations on the use and sale of consumer fireworks that are not in conflict with state law.

Any person, firm, corporation, organization, equitable interest, or other entity, including the officers of any corporation or association, who or which shall be in violation of any provisions of this Part upon conviction thereof will be sentenced to pay a fine of not less than $200 and not to exceed $1,000 and/or to undergo imprisonment for a term not exceeding 90 days. Each day that a violation continues beyond the date fixed for compliance shall constitute a separate offense. In any enforcement action brought under this section, the guilty party shall in addition to any fines pay the costs of prosecution, including reasonable attorney's fees incurred by the Township of West Lebanon.
