All portions of the Town POTW tributary to and interconnected with the City of Oneida POTW are subject to the terms and conditions of Intercommunity Wastewater Service Agreement by and between City of Oneida, Madison County, New York and Town of Verona, Oneida County, New York, dated May 30, 1995, and any amendments thereto. §§ 196-168 through 196-173 are applicable to all such parts of the Town POTW and the requirements in those sections supersede any contradictory requirements in other parts of this Part 1.
In the event that the city provides written notice to the Town of a discrepancy in a standard or requirements between this Part 1 and the city's Sewer Use Ordinance and the city's standard or requirement is more restrictive or protective of the city's POTW than this Part 1, then the Town, upon receiving written notice from the city requesting enforcement of the city's standard or requirement, shall enact appropriate modifications to this Part 1 and shall enforce the applicable city standard or requirement.
Discharge of trucked and/or hauled wastes into any portion of the Town POTW tributary to the City of Oneida POTW is prohibited.
A. 
Unless there is a new connection moratorium in effect, implemented in accordance with the Town of Verona/City of Oneida Intercommunity Agreement, the Town of Verona shall have sole approval authority regarding new connections of residential properties, which do not exceed two dwelling units, to the Town POTW.
B. 
Except for residential properties which do not exceed two dwelling units, the City Engineer shall have final approval authority, which shall not be unreasonably withheld, for applications to connect to the Town POTW received by Superintendent from applicants which propose to discharge or have the potential to discharge, other than domestic sewage. This shall include, but is not limited to: residential properties having three or more dwelling units, commercial properties, institutional services and industrial enterprises. Any such connection permit issued by the Town will include any special conditions and/or discharge limits required by the City Engineer. Any such connection permit denied by the Town will provide the applicant with a written explanation of the basis for denial.
In the case of applications to connect to the POTW received from significant industrial users, the city, acting on behalf of the Town, may directly issue a wastewater discharge permit to such applicants, in accordance with Article X of this Part 1. The city may also directly charge such applicants an annual industrial sewer use permit fee at the rate established in the city's Sewer Use Ordinance. Any such permits issued by the city may include, but shall not be limited to, the provisions listed in Article X of this Part 1, as well as the provisions listed below:
A. 
Discharge flow limits.
B. 
Discharge load limits.
C. 
Sampling, monitoring, testing and reporting requirements.
D. 
Discharge pretreatment requirements.
E. 
Direct payment to the city of an industrial sewer use surcharge to cover the city's costs in treating abnormal sewage.
F. 
Requirement to comply with the city's enforcement response plan, prepared in general accordance with the description set forth in § 196-125 of this Part 1, including any administrative orders issued by the city as provided therein.
G. 
Self reporting.
H. 
Designation of a court having jurisdiction in the event the that permittee fails to comply with any order issued by the city under provisions of the city's enforcement response plan.
The Town of Verona shall comply with any wastewater system new connection moratorium, if so declared by the City of Oneida Common Council consistent with the terms of the Town of Verona/City of Oneida intercommunity agreement or if directed by the New York State Department of Environmental Conservation or any other agency legally empowered to issue such declaration.
All portions of the Town service area tributary to and interconnected with the Village of Sylvan Beach POTW are subject to the terms and conditions of EOLWPAP Intercommunity Agreement, dated March 16, 1977, as modified by agreement of modification, dated October 30, 1991, and any further amendments thereto. §§ 196-174 through 196-178 are applicable to all such parts of the Town service area, and the requirements in those sections supersede any contradictory requirements in other parts of this Part 1.
Introduction into the Town POTW of any sewerage from outside the service area as defined in § 2 of EOLWPAP Intercommunity Agreement, or said service area as legally amended, is prohibited.
The Village of Sylvan Beach, as owner and operator of the POTW treatment plant, shall have the right to refuse introduction into the system of any sewage that can be properly treated by the POTW treatment plant without creating an obnoxious odor or other nuisance.
For the portion of the service area subject to terms and conditions of EOLWPAP Intercommunity Agreement, normal sewage is defined as having the following characteristics:
A. 
Maximum sewage flow (F) equals 150 gallons per capita per day;
B. 
Maximum biochemical oxygen demand (BOD) equals 300 mg/liter;
C. 
Maximum suspended solids (SS) equals 350 mg/liter; and
D. 
Maximum dissolved solids (DS) equals 10,000 mg/liter.
In addition to discharges prohibited in § 196-89, no person shall discharge or cause to be discharged any of the following described waters or wastes to the POTW tributary to the Village of Sylvan Beach POTW Treatment Plant:
A. 
Any waters or wastes which contain grease or oil or other substance that will solidify or become discernibly viscous at temperatures between 32° and 150° F.
B. 
Any waters or wastes containing fats, wax, grease or oils, whether emulsified or not, exceeding an average of 50 milligrams/liter (417 pounds per million gallons) or other soluble matter.
C. 
Any waters or wastes, acid and alkaline in reaction, having corrosive properties capable of causing damage or hazard to structures, equipment and personnel of the sewage works. Free acids and alkalis must be neutralized, at all times, within a permissible pH range of 6.0 to 9.5.
D. 
Any waters or wastes that for a duration of 15 minutes has a concentration greater than five times that of normal sewage as measured by suspended solids and B.O.D. and/or which is discharged continuously at a rate exceeding 1,000 gallons per minute except by special permit. Normal sewage shall be defined as falling with the following ranges:

E. 
No person shall discharge or cause to be discharged any waters or wastes containing a toxic or poisonous substance, a high chlorine demand or suspended solids in sufficient quantity to injure or interfere with any sewage treatment process, constitute a hazard to humans or animals or create any hazard in the receiving waters or the effluent of the POTW treatment plant. Such toxic substances shall be limited to the average concentrations listed hereinafter in the sewage as it arrives at the treatment plant and at no time shall the hourly concentration at the sewage plant exceed three times the average concentration. If concentrations listed are exceeded, individual establishments will be subject to control by the Superintendent in volume and concentration of wastes discharged.

Articles I, II, IV, V, VIII, XI, XII, XIII, XIV and XV shall apply in all incorporated areas of the Town of Verona. Articles III, VI, VII, IX and X shall apply only in incorporated areas of the Town of Verona which are also within the service area of the POTW.
