The following definitions shall apply in the interpretation and enforcement of this chapter:
AIR POLLUTION
The presence in the outdoor atmosphere of one or more added substances in such quantities and of such duration as to be injurious to human, animal or plant life or property or which unreasonably interferes with the comfortable enjoyment of life and property.
BOARD
The Board of Health of the Borough of Demarest.
CODE
This chapter as herein designated, unless some other code is expressly indicated.
DIRECT HEAT EXCHANGER
Equipment in which heat from the combustion of fuel is transferred to a substance being heated so that the latter is contacted by the products of combustion and may contribute to the total effluent.
FOGGING
Spraying in the form of a cloud for the control of insects within a prescribed area.
FUEL-BURNING EQUIPMENT
Any furnace, boiler, water heater, device, mechanism, stoker, burner, stack, oven, stove, kiln, still or other apparatus or a group or collections of such units in the process of fuel burning for the generation of heat or power. Refuse-burning equipment shall be considered incinerators as herein defined and not as "fuel-burning equipment" under this definition. Ovens, stoves or ranges used exclusively for domestic cooking purposes are not included herein.
HEALTH OFFICER
The individual duly appointed or designated by the Board to enforce this code or supervise work on behalf of the Board. The Health Officer shall possess a license as such issued by the State Department of Health.
INCINERATOR
Any device, apparatus, equipment or structure used for destroying, reducing or salvaging by fire any material or substance, including but not limited to refuse, rubbish, garbage, debris or scrap or facilities for cremating human or animal remains.
INDIRECT HEATING EXCHANGER
Equipment in which heat from the combustion of fuel is transferred by conduction through a heat-conducting material to a substance being heated, so that the latter is not contacted by and adds nothing to the products of combustion.
MEMBER
One of the persons who shall constitute the Board of Health.
MILK
The lacteal secretion obtained from one or more cows or goats.
MILK PRODUCTS
Includes ice cream, ice milk, sherbets, butter, butter oil, the various types of cheeses, dried milk, dried skim milk and any other food for human consumption made from milk and designated as a "milk product" by the State Department of Health.
NON-PUBLIC SCHOOL
A private or institution-related school which may be attended in place of a public school.
NUISANCE
Any condition which is dangerous to human life or health or that which renders air, water, soil or any type of food hazardous or injurious to human life or health, and as otherwise herein defined.
NURSE
A person licensed as such under the laws of the State of New Jersey.
OPACITY
The property of a substance which renders it partially or wholly obstructive to the transmission of visible light expressed as the percentage to which the light is obstructed.
OPEN BURNING
Any fire wherein the products of combustion are emitted into the open air and are not directed thereto through a stack or chimney.
PERSON
Any person, association, partnership, trust or corporation or any one or more of them or a combination of any of them.
POLLUTED
Dirty or defiled, unfit for human consumption or detrimental to health.
REGISTRAR
A person appointed by the Registrar of the State of New Jersey for a period of three years.
RINGELMANN SMOKE CHART
The Ringlemann Scale for Grading and Density of Smoke, as published by the United States Bureau of Mines or any chart, recorder, indicator or device which is approved by the New Jersey Department of Environmental Protection as the equivalent of said Ringlemann Scale or for the measurement of smoke density.
SANITARIAN
A first class sanitary inspector, possessing a license as such from the State Department of Health, appointed by the Board to aid in the enforcement of the rules, regulations and ordinances of the Board of Health.
SANITARY SEWER
A sewer which carries sewage and to which stormwater, surface water and groundwater are not admitted.
SMOKE
Gas- or airborne small particles by combustion or other heat release or heat-application processes in a concentration sufficient to be observable.
SPRAYING
Mechanical application of insecticides to bushes, trees or plants.
STACK OR CHIMNEY
A flue, conduit or opening designed and constructed for the purpose of emitting air contaminants into the outdoor air.
STATE BOARD OR STATE DEPARTMENT
The New Jersey Public Health Council or State Department of Health or any successor agency thereto.
TENANT
Any person occupying any house, building or portion thereof, which is rented, leased, let or hired out to be occupied as a house, residence or a business establishment.
VISIBLE SMOKE
Smoke which obscures light to a degree readily discernible by visual observation.
