All premises on which animals are kept must be maintained in a sanitary condition. A public nuisance shall be deemed to exist in the following circumstances:
A. 
The keeping of animals above in a manner that may foster the breeding of insects and rodents and germination of bacteria and other infectious microbes, all of which may cause disease.
B. 
The keeping of animals in a manner that may create foul and noxious odors as well as disturbing noises.
No person shall keep any small animal infected with a disease contagious to other animals or human beings without being under the treatment of a veterinarian. Animals or fowl infected with diseases threatening the life of other animals or human beings, not under the treatment of a veterinarian, must be immediately destroyed, and the carcass cremated forthwith. Any such hutch, pen, coop or enclosure wherein such animal or fowl is found shall be destroyed or thoroughly disinfected in an approved fashion.
Any use existing on the date of adoption and not in compliance with provisions of §§ 189-73 and 189-74 herein may be continued as a preexisting use, subject, however, to the provisions of § 189-75. A preexisting use may not be extended.
