[HISTORY: Adopted by the Annual Town Meeting of the Town of Whately 2-24-1968 by Art. 18. Amendments noted where applicable.]
The Town voted to form, with the contiguous Towns of Sunderland and Deerfield, under the provisions of General Laws, Chapter 40, §§ 12B through 12G, as added by Chapter 576 of the Acts of 1953, a district to be known as the "Tri-Town Beach District," for the purpose of acquiring, whether by gift or otherwise, developing, maintaining and operating within the Town of Whately beaches for public and recreational uses[1].

Editor's Note: At a Special Town Meeting held 7-11-1968, the Town of Whately accepted the withdrawal of the Town of Sunderland from the Tri-Town Beach District as voted by the Town of Sunderland at a Special Town Meeting held 6-12-1968.

Such district shall be under the control of a commission which shall be appointed by and the number and terms of office of the members of which shall be determined by a joint committee composed of the Chairs of the Selectboards of Deerfield and Whately.
A condition of the formation of said Tri-Town Beach District shall be that withdrawal of any member town shall be by a vote at its Annual Town Meeting, effective at the end of the year in which such meeting shall take place, and that, until said effective date, such withdrawing town shall be obligated to pay its proportionate share, up to its proportionate share for the preceding year, of the net operating expenses of said district after deducting operating income of said district from concessionaires, fees and other sources.
