Notwithstanding the provisions of MGL c. 41, § 1, and any general or special law to the contrary, the Selectboard of the Town of Whately shall, from a list of a minimum of three candidates recommended by the Screening Committee as set forth in § 50-2, upon the expiration of the terms of the present incumbents, appoint a person to the office of Town Treasurer and Collector of said Town and thereby establish the office of Treasurer and Collector. The Town Treasurer and Collector so appointed shall have all the powers, perform the duties and be subject to the liabilities and penalties now or hereafter conferred or imposed by law on town treasurers and collectors. Upon appointment and qualification, such Town Treasurer-Collector shall serve for a term of three years and until a successor is appointed and qualified. The Treasurer-Collector may be removed for cause at a public hearing by the Selectboard and the vacancy filled by appointment in the same manner as in the case of the original appointment. The position of Town Treasurer and Collector shall not be subject to the provisions of MGL c. 31. Compensation shall be established within the classification and pay plan of the Town bylaws for the salary of the Treasurer-Collector and as recommended by the Personnel Committee and set by the Selectboard.
The Screening Committee shall be composed of seven persons as follows: a member of the Selectboard, a member of the Personnel Committee, the Town Administrator and four citizens of Whately to be appointed by the Town Moderator. Insofar as possible, they shall be knowledgeable in municipal finance, data processing, human resources, law or other similar proficiencies.
In the event that either or both of the present Town Treasurer and Town Collector resign, are permanently disabled or otherwise are unable to perform the duties of their offices prior to the expiration of their respective terms, the Selectboard of said Town may implement such provisions of § 50-1 as may be necessary to continue the orderly administration of these offices.
