[HISTORY: Adopted by the Annual Town Meeting of the Town of Whately 4-24-1990 by Art. 13. Amendments noted where applicable.]
For the purposes of this chapter, the following terms shall have the meanings indicated:
RECYCLABLES
The discarded materials described below which may be reclaimed and are considered usable by reprocessing industries:
A. 
ALUMINUMCans made from aluminum, aluminum foil, aluminum wrappers and containers or trays used in the packaging, preparation or cooking of prepared dinners, pies, cakes or other foods.
B. 
GLASSAll unbroken jars and bottles or similar products made from silica or sand, ash, soda and limestone, the product being transparent or translucent and being used for packing or bottling of various matter, and all other material commonly known as "glass," excluding the following:
(1) 
Blue and flat glass, commonly known as "window glass."
(2) 
Dishes and crockery.
(3) 
Light bulbs.
(4) 
Bottles formerly containing poisons, pesticides or petroleum products.
C. 
CARDBOARDCorrugated boxes, cardboard cartons, pasteboard and similar corrugated and craft paper materials, excluding the following:
(1) 
Wax- or plastic-coated cardboard.
(2) 
Cardboard contaminated with oil, grease, food or other contaminants that would render it unsuitable for reprocessing.
D. 
PAPERAll wastepaper products, including newsprint, newspaper supplements, magazines, wrapping paper, junk mail, etc., excluding the following:
(1) 
Wax paper.
(2) 
Envelopes with plastic windows.
(3) 
Paper products contaminated with food, grease, oil, etc.
(4) 
Diapers and sanitary products.
E. 
FERROUS METAL CANSAll containers composed in whole of iron or steel and so-called "tin" cans used for the packaging or storing of various food and nonfood items, excluding the following:
(1) 
Containers which contained paint or petroleum-based solvents.
(2) 
All aerosol spray cans.
(3) 
Cans formerly containing poisons and petroleum products.
F. 
Any other materials (such as plastics) which the Board of Health may in the future deem recyclable.
All recyclable materials must be clean and uncontaminated. All glass, metal cans, aluminum food trays, etc., must be washed before being deposited in recycling bins.
A. 
Recyclable paper shall be placed in the recycling shed/receptacle/container in a manner to prevent the scattering of paper.
(1) 
Newspapers shall be securely tied in flat bundles, none of which shall weigh more than 50 pounds.
(2) 
All other paper shall be either tied in bundles or placed in paper bags.
(3) 
Corrugated boxes and cardboard cartons must be flattened and placed in the appropriate receptacle/container.
(4) 
Glass and metal cans shall be placed in the appropriate containers provided.
B. 
Recyclables shall not be placed in plastic garbage bags for collection, removal or disposal. Recyclables shall not be placed in the same refuse container as or otherwise mixed with other forms of solid waste for collection, removal or disposal.
A. 
Upon collection by the Town of Whately pursuant to the program established hereby and the rules and regulations issued hereunder, such recyclable materials shall become and be the property of the Town of Whately. It shall be a violation of this chapter for any unauthorized person, except employees of the Town or contractors hired by the Town, to collect or pick up or cause to be collected or picked up any recyclable material. Any and each unauthorized collection or pickup in violation hereof shall be a separate and distinct offense punishable as hereinafter provided.

B. 
Any violation of this section, or any part hereof, shall be punishable by a fine not to exceed $250, and the violator shall make restitution to the Town for the value of any recyclables illegally removed.
This chapter shall be in effect after the Board of Health has published a public notice detailing the procedures and starting date(s).
If any provision, sentence or phrase thereof shall be held invalid for any reason, the remainder of this chapter shall continue in full force.
