PEDDLER
Any person who shall engage in peddling, as herein above
defined.
PEDDLING
Engaging in peddling, canvassing, soliciting, or taking of
orders, either by sample or otherwise, for any goods, wares, or merchandise,
upon any of the streets, sidewalks, or from house to house within
the Township of East Fallowfield; provided, the word peddling shall
not apply (A) to farmers selling their own produce, (B) to the sale
of goods, wares, and merchandise, donated by the owners thereof, the
proceeds whereof are to be applied to any charitable or philanthropic
purpose, or (C) to any manufacturer or producer in the sale of bread
and bakery products, meat or meat products, milk or milk products.
PERSON
Any natural person, association, partnership, firm, or corporation.
In this Part, the singular shall include the plural and the
masculine shall include the feminine and the neuter.

No person shall engage in peddling in the Township of East Fallowfield
without first having taken out a license as herein provided.

Every person desiring to engage in peddling in the Township
of East Fallowfield, shall first make application to the Secretary
of the Township, or the Secretary's deputy or deputies appointed
for this purpose, for a license. Upon such application such person
shall give his name; permanent address at which he will receive notices
under this Part; address; his previous criminal record; excepting
minor traffic offenses, if any; the name of the person for whom he
works, if any; the type of goods, wares, and merchandise he wishes
to peddle; the length of time for which he wishes to be licensed;
the type of vehicle he uses, if any; and the number of helpers he
has. Provided when a person makes application for himself and one
or more helpers, all applicable personal information specified above
shall be given for each helper, and an individual license shall be
required for each helper. No license issued under this Part shall
be transferable from one person to another.

No license shall be issued under this Part until the proper
fee, as shall be established from time to time by resolution of the
Board of Supervisors, shall be paid to the Secretary or his deputy,
which shall be for the use of the Township.

Upon making application thereof and paying the proper fee as
herein specified, a license shall be issued to every peddler, provided
that the Township Secretary may refuse to issue a license if he has
reasonable grounds for believing the applicant to be of poor moral
character, and the applicant shall be required to apply in person
to the Board of Supervisors. Such license shall contain the information
required when engaged in peddling in the Township, carry such license
upon his person, and shall exhibit such license upon request, to all
police officers, Township officials, and citizens. No peddler shall
engage in selling any produce as mentioned in this license.

No peddler shall engage in any business activity, except by
prior appointment, at any time on a Sunday or legal holiday or at
any time before 9:00 a.m. or after sundown on any day of the week
other than a Sunday or legal holiday.

No person, licensed as a peddler under this Part, shall hawk
or cry his wares upon any of the streets or sidewalks of the Township,
nor shall be use any loud speaker or horn or any other device for
announcing his presence by which the public is annoyed. No person
licensed as a peddler under this Part shall enter, or attempt to enter,
any dwelling house without invitation or permission of the occupant
and shall immediately leave any premises upon request.

No person licensed as a peddler under this Part, shall occupy
any fixed location upon the streets or sidewalks of the Township for
the purpose of peddling, with or without any stand or counter.

The Township Secretary is hereby authorized and empowered to
suspend any license issued under this Part, when he deems, from information
received, such suspension to be beneficial to the public health, safety,
or morals, or for violations of any of the provisions of this Part,
or for giving false information on the application for a license thereunder.
Notice of such suspension shall be given by written notice personally
served or sent by registered mail to the address shown on the application.
The holder of the suspended license shall immediately surrender his
license to the Township Secretary.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $25 nor more than
$1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 90 days. Each day that a violation
of this Part continues or each section of this Part which shall be
found to have been violated shall constitute a separate offense.
