1. Permit and Approval Required. No person or entity shall construct
a driveway, access road, or way bisecting or intersecting in any manner
with a Township road, a drainage ditch or other ditch, culvert, pipe,
conduit, gutter, or the like or shall make any alteration of the grade
or erect or construct any obstruction to the continued used of the
roads, footwalks, culverts, drains, and bridges of the Township in
or abutting the right-of-way of any Township road without first making
an application for and obtaining approval and permit as evidence of
the same from the Supervisors of East Fallowfield Township.
2. Fee. Applications shall be made to the Township Secretary and accompanied
by a fee, in an amount as established from time to time by resolution
of the Board of Supervisors, for each such permit requested.
3. Issuance of Permit. Upon approval of the Township Supervisors the
Township Secretary shall be instructed to issue the permit as evidence
thereof.
4. Penalty for Violations. Any person or entity who shall be in violation
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $10 nor more than
$1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 90 days. Each day that a violation
of this Part continues or each section of this Part which shall be
found to have been violated shall constitute a separate offense.
