It is the intent and purpose of this Part to ensure the preservation of Township-owned, -operated, and/or -managed park lands, recreation facilities and conservation areas within the Township for the perpetual enjoyment of the residents of the Township, to regulate activities within these areas consistent with the enjoyment and preservation of unspoiled natural settings and park facilities, and to prevent any nuisance to the residents of the Township in the use of such Township-owned, - operated, and/or -managed park lands, recreation areas and conservation areas or in the enjoyment of private property adjacent to such areas. This Part shall apply to all parks, lands, recreation facilities and conservation areas now or hereafter owned, operated, and/or managed by the Township (for purposes of this Part, hereafter referred to as the "Township parks"); provided, that nothing set forth herein is intended to be in conflict with or inconsistent with the requirement of any federal or state regulation appurtenant to use of any facility acquired or developed with federal or state funds as relates to the use of such facility.

The following rules and regulations shall apply to the Township parks:
A. 
Grass areas shall not be used for roadways, parking or for other purposes which may injure or destroy the turf or landscaping. The use of metal detectors, digging, pounding stakes or the erection of tents and canopies is prohibited.
B. 
Trees, shrubs, hedges, berries, wild flowers or other flowers shall not be picked, cut, broken or injured in any way whatsoever.
C. 
Buildings, fences, fountains, benches or signs shall not be injured or defaced in any way.
D. 
Paper, rubbish, glass bottles or any refuse whatsoever shall not be scattered but must be deposited in receptacles provided for that purpose. Trash receptacles and dumpsters located at Township parks shall be used solely for park litter and picnic trash. Use for the deposition of personal trash, home or business rubbish and rubbish from the cleaning of vehicles is prohibited.
E. 
No hunting shall be allowed in the Township parks.
F. 
Lotteries or other gambling or games of chance, drunkenness, disorderly or indecent conduct and profane or offensive language are prohibited.
G. 
The Township parks shall not be used for cleaning, polishing or repairing of automobiles.
H. 
It shall be unlawful for any person to have in his or her possession, custody or control any alcoholic beverage, including beer, of any kind whatsoever in any of the Township parks without a properly issued Township permit (see § 16-103 of this Part).
I. 
The sale of tickets or any commodities by groups is prohibited without authorization of the Township.
J. 
Fires shall not be built or allowed anywhere in the Township parks other than in the stoves or fireplaces provided for that purpose without written permission of the Township Manager.
K. 
The use and discharge of any fireworks at any time in the Township parks is prohibited, except where such use and discharge is provided by the Township.
L. 
Public meetings, assemblages or parades shall not take place within the Township parks without the written permission of the Township Manager.
M. 
No person or persons whatsoever shall sell or offer to sell any article or service for hire within the limits of the Township parks or set up therein any stand or booth for such purpose or distribute or display handbills, cards or advertisements of any nature whatsoever unless duly authorized to do so by the Parks Director.
N. 
Picnics are allowed only on locations provided for that purpose. Persons holding picnics shall clean up and place all wastepaper and other refuse in receptacles provided for that purpose.
O. 
Vehicles shall not exceed 15 miles per hour in the Township parks. Operating a vehicle in a reckless or negligent manner or in excess of the posted speed limit is prohibited.
P. 
Motor Vehicles.
(1) 
Only licensed motor vehicles shall be permitted on designated roadways within the Township parks.
(2) 
Motor scooters, mini bikes, go-carts, snowmobiles and all-terrain vehicles (ATVs) shall not be permitted in the Township parks.
(3) 
All vehicles shall be parked in areas or places so designated. Parking in places contrary to posted regulations and times is prohibited. Any vehicles parked in violation of this paragraph may be removed by the Township at the owner's expense. All parking is prohibited outside of the operating hours of the Township parks referenced in § 16-105.
Q. 
It shall be unlawful for any person to intentionally land a private or commercial plane or helicopter on any area within the Township parks.
R. 
It shall be unlawful for any person in the Township parks to:
(1) 
Disturb the peace or use profane or obscene language.
(2) 
Endanger the safety of any person or property by any conduct or act.
(3) 
Commit any assault or battery or engage in fighting.
(4) 
Engage in any sexual activity in any form.
(5) 
Violate any rule for the use of the Township parks established by the Township Manager and posted at a facility or area within the Township parks.
(6) 
Prevent any person from using any area or facilities within the Township parks or interfere with such use in compliance with this Part and the rules applicable to such use.
(7) 
Act in an unlawful, disorderly or disruptive manner or against the best interests of the areas or other people.
S. 
Additional rules and regulations for Township parks may be established from time to time by the Township Manager provided that such rules and regulations are posted at the Township parks and such rules and regulations are not overridden by the Board of Supervisors.

It shall be unlawful for any person in any of the Township parks to carry, possess or drink any alcoholic beverages, including beer, without a permit issued by the Township. Such permits are available with a shelter and/or building reservation.
2. 
Any person or persons under the legal drinking age caught consuming any alcoholic beverage and any person or persons responsible for the distribution of alcoholic beverages to anyone under the legal drinking age will be prosecuted to the fullest extent of the law.
3. 
No alcoholic beverages are permitted in glass containers, and alcoholic beverages must be confined to the shelter and/or building for which the permit is obtained.

Permits for any activities requiring them can be obtained in the office of the Township Manager during regular business hours.

Township parks shall be open daily to the public from 8:00 a.m. to dusk unless said areas are artificially lighted, in which event said areas shall be open to 10:30 p.m., and it shall be unlawful for any other person or persons to be in the park after such time. For purposes of this Part, dusk shall be defined as the beginning of darkness in the evening and is synonymous with that time immediately after sunset.
2. 
For special activities, (i.e., community days, holiday celebrations, athletic tournaments) the recreation, park and conservation areas which are artificially lighted shall be open until 11:00 p.m.
3. 
Township parks may be open earlier than 8:00 a.m. and later than 11:00 p.m. with the permission of the Township Manager.
4. 
All parking within Township parks is prohibited after the regular closing time or 10:30 p.m., whichever is later, unless it is in connection with a specially authorized activity, in which case parking shall be prohibited after 11:00 p.m. or the specially authorized time set by the Township Manager.

Dogs and other domestic animals shall not be permitted in areas of the Township parks utilized for active or organized recreational purposes (including all ball fields and play areas), roadways and eating areas.
2. 
Dogs and other domestic animals are prohibited from Township parks during special events.
3. 
Dogs and other domestic animals are permitted on designated hiking trails and accessways only.
4. 
Dogs and other domestic animals must be on a leash no longer than six feet and under control by the person or persons responsible. Electronic dog collars are not considered a leash.
5. 
All persons must clean up after their dog or other domestic animal.
6. 
Horses are not permitted in any area of the Township parks.
7. 
The Township Manager may grant an exception to the provisions of this section upon receipt of a written request and upon determination that the exception is for an authorized special event (i.e., dog show, exhibition, etc.), civic purpose or provides a benefit to the general health, safety and welfare of the general public.
8. 
Nothing in this section shall be interpreted as prohibiting or restricting the use of guide dogs or other domesticated animals necessary and working for the physically challenged, police dogs or other authorized canine security patrols and other uses necessitated by municipal, county, state or federal laws or regulations.

The Board of Supervisors may, by resolution adopted from time to time, establish a schedule of fees as shall be necessary for the use and/or rental of Township parks and the facilities located therein.

Any person, firm, or corporation who shall violate any provision of this Part, or fails to comply therewith, or with any of the requirements thereof, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs, including reasonable attorney fees incurred by the Township, and, in default of payment of said fine and costs, to a term of imprisonment to the extent permitted by law for the punishment of summary offenses. A separate offense shall arise for each day or portion thereof in which a violation of this Part is found to exist and for each section of this Part found to have been violated. The Township may also commence appropriate actions in equity or other to prevent, restrain, correct, enjoin, or abate violations of this Part. All fines and penalties collected for violations of this Part shall be paid to the Township Treasurer. The initial determination of ordinance violation is hereby delegated to the Township Manager, Parks Director, the Police Department, the Code Official, the authorized designee of the Township Manager, and to any other officer or agent that the Township Manager or the Board of Supervisors shall deem appropriate.
