A. 
Whenever any abandoned, lost, stolen or unclaimed motor vehicle or other vehicle comes into the possession or custody of any person in this Village who does not know the identity of the owner or any other person legally entitled to the possession of the vehicle, such person shall immediately notify the municipal police.
B. 
Upon receipt of such notification, the municipal police may authorize a towing service to remove and take possession of the abandoned, lost, stolen or unclaimed motor vehicle or other vehicle, and such towing service shall safely keep such vehicle until it is claimed by the owner or any other person legally entitled to possession of the vehicle, or until it is disposed of as provided in this article.
Whenever any motor vehicle or other vehicle is left unattended on any highway, street, or alley for more than 24 hours, the municipal police may authorize a towing service to remove the vehicle until it is claimed by the owner or any other person legally entitled to possession of the vehicle or until it is disposed of as provided in this article.

A. 
Whenever a motor vehicle or other vehicle is authorized to be towed away as provided in this article, the police headquarters shall keep and maintain a record of the vehicle towed, listing the color, year of manufacture, manufacturer's trade name, manufacturer's series name, body style, vehicle identification number and license plate number displayed on the vehicle. The record shall also include the date and hour of tow, location towed from, location towed to, reason for towing and the name of the officer authorizing the towing.
B. 
At the end of five days, after all efforts to identify the towed vehicle and obtain a disposition therefor have met with negative results, a copy of the report shall be forwarded to the Department of Public Safety, Division of State Police, Vehicle Investigation Section.
A. 
Upon receipt of the report required by § 265-3, the State Police, Vehicle Investigation Section, shall examine the title and registration records of the state, pursuant to 625 ILCS 5/4-200 et seq., and forward any chain of title information found on the motor vehicle or other vehicle to the Police Department.
B. 
Upon receipt of the title or registration information from the State Police, Vehicle Investigation Section, the Police Department shall notify the registered owner of the vehicle or any other person legally entitled to possession of the vehicle by certified mail, requesting disposition.
A. 
If the registered owner or any other person legally entitled to possession of the motor vehicle or other vehicle cannot be identified from the files of the Secretary of State or the files of the registration authority of the state where the vehicle is apparently licensed, the Police Department shall notify the Vehicle Investigation Section of the State Police, so that the State Police may take the necessary steps to identify and trace the owner or other person legally entitled to possession of the vehicle.
B. 
When the State Police locate or determine the owner or other person legally entitled to possession of the vehicle, the disposition information determined will be forwarded immediately to the police agency having custody of the motor vehicle or other vehicle.
C. 
It will be the responsibility of the requesting police agency to notify the towing service having possession of the vehicle of the ownership and disposition information.
At any time before a motor vehicle or other vehicle is sold at public sale or disposed of as provided in this article, the owner or other person legally entitled to possession of such vehicle may reclaim the vehicle upon presenting to the law enforcement agency having custody of the vehicle proof of ownership or proof of the right to possession of the vehicle. No vehicle shall be released to the owner or other person under this article until all towing, storage, processing charges, fines, and assessments have been paid.

Whenever an abandoned, lost, stolen, or unclaimed motor vehicle or other vehicle remains unclaimed by the registered owner or any other person legally entitled to possession of the vehicle for a period of 30 days after notice has been given as provided in this article, the towing service having possession of the vehicle shall cause such vehicle to be sold at public sale to the highest bidder.
B. 
Notice of the time and place of the sale shall be posted in a conspicuous place for at least 10 days prior to the sale outside the main office of the towing service and the county courthouse in the county where the main office of the towing service is located.
C. 
At least 10 days prior to the sale, the towing service shall also cause a notice of the time and place of the owner and any other person known to the towing service to be legally entitled to possession of the vehicle. Such notice shall contain a complete description of the vehicle to be sold and what steps must be taken by any interested person to recover the vehicle.
Whenever the identity of the registered owner or any other person legally entitled to possession of an abandoned, lost, stolen, or unclaimed vehicle cannot be determined by any means provided for in this article, the vehicle may be sold or disposed of in the manner authorized by § 265-5 or 265-7 of this article, and 625 ILCS 5/4-200 et seq., without notice to the registered owner or any person legally entitled to possession of the vehicle.
The proceeds from the public sale or disposition of a motor vehicle or other vehicle in accordance with the provisions of this article, after deducting towing and storage charges and the expenses of the public sale or disposition, shall be deposited in the treasury of the Village.

When a motor vehicle or other vehicle in police custody is reclaimed by the registered owner or other person legally entitled to possession of such vehicle, or when such vehicle is sold at public sale or otherwise disposed of as provided in this article, the law enforcement agency having custody of the vehicle shall note this fact on the agency copy of the report required by 625 ILCS 5/4-204, and notice of such final disposition of the vehicle shall be forwarded to the Department of Public Safety, Division of State Police, Vehicle Investigation Section, for notation on its copies of such report.
B. 
If the vehicle bore registration plates from a state other than the State of Illinois at the time it was picked up by the towing service, notice of the final disposition of the vehicle shall also be sent to the registration authority of the state listed on the registration plates by the State Police, Vehicle Investigation Section.
No law enforcement officer or agency, towing service owner or employee or any other person shall be held to answer, or be liable for damages in any action brought by the registered owner, former registered owner, or his legal representative, or by any other person legally entitled to possession of a motor vehicle or other vehicle, if the vehicle was handled or sold or disposed of by such law enforcement officer or agency, towing service owner or employee or other person in a manner authorized by this article.
