A. 
There is hereby established in the Borough of Demarest a State Uniform Construction Code enforcing agency to be known as the "Borough of Demarest State Uniform Construction Code Agency," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23, provided that in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.

The public shall have the right to do business with the enforcing agency at one office location, except for emergencies and unforeseen or unavoidable circumstances.
A. 
Establishment; qualifications of members. There is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five members. At least one Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one Board member shall be as qualified as a Plumbing Subcode Official and one as qualified as an Electrical Subcode Official. No more than two Board members shall be selected from the same business or profession. Each Board member shall have had at least three years' experience in construction, design or supervision as a licensed engineer or registered architect or, in the alternative, five years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education or, as a further alternative, 10 years' experience in construction, design or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor or inspector.
B. 
Appointment and terms of members.
(1) 
The Mayor of the Borough of Demarest shall nominate, subject to confirmation by the Council, the Board members and any alternate members. For the members first appointed, the Mayor and Council of the Borough of Demarest shall designate the appointees' terms so that one shall be appointed for a term of one year, one for a term of two years, one for a term of three years and two for a term of four years. At the expiration of such terms and thereafter, appointments shall be made for terms of four years. Vacancies shall be filled for the unexpired term.
(2) 
The Mayor of the Borough of Demarest shall nominate, subject to confirmation by the Council, such number of alternates as may be appropriate for terms not to exceed four years or may, in the alternative, appoint alternates on a case-by-case basis.
(3) 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
C. 
Compensation. The members of the Board shall not be compensated but may be reimbursed for expenses incurred, on vouchers submitted to and approved by the Mayor and Council of the Borough of Demarest.

A. 
The fee for a construction permit shall be paid before the permit is issued. The minimum fee shall be $50.
(1) 
The Building Subcode fees shall be as follows:
(a) 
For new construction and additions: $0.045 per cubic foot of building or structure volume.
(b) 
For renovations, alterations, siding, roofing, decks and repairs: $25 per $1,000 of estimated cost of the work.
(c) 
For combinations of renovations and additions: the sum of the fees computed separately as renovations and additions.
(d) 
Underground storage tanks, abandonment/removal: $55.
(2) 
The Plumbing Subcode fees shall be as follows. The minimum fee shall be $50.
(a) 
Per plumbing fixture, device and plumbing stack to be installed: $20.
(b) 
Per special device for grease traps, oil separators and water-cooled air-conditioning units: $50.
(c) 
Per sanitary sewer connection: $60.
(3) 
The electrical subcode fees shall be as follows. The minimum fee shall be $50.
(a) 
Receptacles.
[1] 
From one to 25 receptacles or fixtures: $50.
[2] 
For each additional 25 receptacles: $25.
[3] 
Receptacles include but are not limited to lighting outlets, wall switches, fluorescent fixtures and motors of less than one horsepower or devices of less than kilowatt.
(b) 
For each motor or electrical device greater than one horsepower and less than or equal to 10 horsepower: $30.
(c) 
For transformers and generators greater than one kilowatt and less than or equal to 10 kilowatts: $30.
(d) 
For each motor or electrical device greater than 10 horsepower and less than or equal to 50 horsepower: $45.
(e) 
For each service panel, service entrance or subpanel less than or equal to 200 amperes: $60.
(f) 
For all transformers and generators greater than 10 kilowatts and less than or equal to 45 kilowatts: $50.
(g) 
For each motor or electrical device greater than 50 horsepower and less than or equal to 100 horsepower: $60.
(h) 
For each service panel, service entrance or subpanel greater than 200 amperes and less than or equal 1,000 amperes: $75.
(i) 
For transformers and generators greater than 45 kilowatts and less than or equal to 112.50 kilowatts: $60.
(j) 
Pool/vault fee: $75.
(k) 
Spa/hot tubs fee: $75.
(l) 
Temporary service: $50.
(m) 
Whirlpool fee: $45.
(n) 
Air-conditioning units, one ton through five tons: $50.
(4) 
The Fire Protection Subcode fees shall be as follows:
(a) 
For gas or oil heat or oil heating systems installation: $50.
(b) 
For installation of a fuel storage tank for a residential building: $50.
(c) 
For installation of fuel, oil or gasoline storage tanks in connection with a commercial or business building, the fee shall be:

For each tank 1,000 gallons' capacity: $100.
[2] 
For each tank 1,001 gallons' to 3,000 gallons' capacity: $200.
[3] 
For each tank in excess of 3,000 gallons' capacity: $275.
(d) 
For a solid-fuel heating appliance, fireplace or woodstove: $50.
(e) 
For installation of sprinkler systems, the fees shall be as follows:

For one to 25 heads: $100.
[2] 
For 26 to 75 heads: $150.
[3] 
For 76 to 100 heads: $200.
[4] 
For over 100 heads: $250.
(f) 
Smoke detectors.
[1] 
For installation of one to five smoke detectors: $50.
[2] 
For each addition detector over five: $5.
[3] 
For inspection upon change of occupancy of a structure used or intended for residential purposes by not more than two households pursuant to P.L. 1991, c. 92:[1] $40.

(g) 
Special fire suppression systems, including cooking suppressions systems, CO2, halon, etc.: $75 (sprinkler systems not included).
(h) 
In new construction for installation of heating appliances, fireplaces, smoke detectors and fuel storage tanks for a single-family residential use: flat fee of $200.
(i) 
Automatic fire detection and alarm system: $100.
B. 
Plan review.
(1) 
The fee for plan review shall be 20% of the amount to be charged for the construction permit. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit. In addition, the following sums shall be paid in escrow in connection with all new construction of or additions to one- and two-family residences:
(a) 
New construction: the sum of $1,000 for site inspections by the Borough Engineer. The sum posted hereunder shall remain on deposit with the Borough until the Borough Engineer certifies that all site inspections have been completed and all vouchers for services rendered in connection with such services have been paid in full, after which time any balance remaining shall be refunded. This subsection is solely applicable to new construction on a vacant lot.
(b) 
Additions. The following sums shall be paid in connection with construction of any addition that disturbs the soil: $150 for construction of 750 square feet or less plus $50 for each additional 250 square feet. The sum posted hereunder shall remain on deposit with the Borough until the Borough Engineer certifies that all site inspections have been completed and all vouchers for services rendered in connection with such services have been paid in full, after which time any balance remaining shall be refunded upon issuance of a certificate of occupancy.
(2) 
Should the escrow funds initially deposited hereunder be exhausted prior to completion of all site inspections, the Borough Engineer shall submit an estimate of additional funds required to complete such inspections, whereupon the applicant shall forthwith deposit with the Borough such additional escrow funds.
C. 
The fee for a permit for demolition of a building or structure shall be $750.
D. 
The fee for a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be $150.
E. 
The fee for a permit to construct a sign shall be $50.
F. 
Fences.
(1) 
The fee to erect a brick, masonry or wrought iron fence or any fence requiring poured footings shall be $10 per $1,000 estimated cost with a minimum fee of $35.
(2) 
The fee to erect any fence not requiring footings shall be $10 per $1,000 estimated cost with a minimum fee of $15.
G. 
The fee for a permit to construct tennis courts, paddle tennis courts, a permanent swimming pool, recreational facilities or any other appurtenant structure shall be $25 per $1,000 of estimated cost of the work.
H. 
The fee for installation of an elevator shall be pursuant to the Uniform Construction Code, N.J.A.C. 5:23-4.20. Permits shall be obtained directly from the Department of Community Affairs for the State of New Jersey.
I. 
Elevator inspection fees shall be pursuant to the Uniform Construction Code, N.J.A.C. 5:23-4.20. Inspections shall be conducted by the Department of Community Affairs for the State of New Jersey.
J. 
Surcharge fee. In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, in addition to the fees specified above, a surcharge of $0.0016 per cubic foot of volume of new construction and $0.80 per thousand of estimated cost of alterations shall be collected.
K. 
Certificates. The fees for certificates shall be as follows:
(1) 
For a certificate of occupancy or temporary certificate of occupancy for all new construction: $100.
(2) 
For a certificate of approval or temporary certificate of approval of alterations and renovations, except as noted in Subsection K(4) below: $50 each.
(3) 
For certificate of continued occupancy, for certificate of occupancy pursuant to a change of use, for multiple certificates of occupancy and similar conditions: $75.
(4) 
For a certificate of approval for alterations, renovations, decks, pools and tennis courts: $15 each.
L. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Mayor and Council of the Borough of Demarest biannually a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
