The creation, within the Borough of Bristol, of any unnecessary or excessive noise or of any noise of such character, intensity or duration as to be detrimental to the health or safety of any individual or in the disturbance of the public peace and welfare, or the aiding and abetting in the creation of any such noise or suffering or permitting any such noise to continue is hereby prohibited and shall constitute unlawful conduct.

1. 
Prohibited noise, within the meaning of this Part, is hereby defined as follows:
A. 
For any person at any time to use a horn or other warning device otherwise than as a reasonable warning or to make any unnecessary, unreasonable, loud or harsh sound by means of a horn or other warning device.
B. 
The playing of any radio, phonograph, tape or disc player or any musical instrument in such a manner or with such volume as to annoy or disturb the quiet, comfort or repose of persons in any office, hospital or any dwelling, hotel or other type of residence or of any persons in the vicinity thereof. It shall be considered a violation if the sound level is audible at a distance greater than 100 feet from the location of such player or instrument.
C. 
Yelling, shouting, hooting, whistling or singing on the public streets so as to annoy or disturb the quiet, comfort or repose of any persons in any hospital, nursing home, personal care center, dwelling, hotel or other type of residence or of any persons in the vicinity thereof.
D. 
The creation of any excessive noise on any street adjacent to any school, institution of learning, church or court, while the same are in session, which unreasonably interferes with the workings of sessions thereof and the making of any other noise so as to annoy the users and/or occupants of such places or buildings as are herein defined.
E. 
The running or idling of an engine of a parked truck within 300 feet of a residential zone or district between the hours of 10:00 p.m. to 7:00 a.m.

1. 
None of the terms or prohibitions hereof shall apply to or be enforced against:
A. 
Any vehicle or personnel of the Borough of Bristol while engaged upon necessary public business or vehicles responding to an emergency call or acting in the time of emergency.
B. 
Parades with band music on holidays or by civic organizations or by churches, schools or divisions of schools.
C. 
School sports events which may or may not be accompanied by cheering and/or music.
D. 
The reasonable use of amplifiers or loud speakers in the course of public addresses which are noncommercial in character.
E. 
Fireworks exhibits held under permit by the Borough of Bristol.

1. 
Applications for a permit for relief from the noise level designated in this Part on the basis of undue hardship may be made to the Borough Manager or his duly authorized representative. Any permit granted by the Borough Manager hereunder shall contain all conditions upon which said permit has been granted and shall specify a reasonable time that the permit shall be effective. The Borough Manager, or his duly authorized representative, may grant the relief as applied for if he finds:
A. 
Additional time is necessary for the applicant to alter or modify his activity or operation to comply with this Part.
B. 
The activity, operation or noise source will be of temporary duration and cannot be done in a manner that would comply with other subsections of this section.
C. 
No other reasonable alternative is available to the applicant.
2. 
The Borough Manager may prescribe any conditions or requirements he deems necessary to minimize adverse effects upon the community or the surrounding neighborhood.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
