In order to engage in municipal towing services within the Township
of Knowlton, all contractors, businesses and garages shall be so authorized
and appointed by the Township Committee of the Township of Knowlton
and shall meet the following liability insurance qualifications to
engage in the municipal towing services:
A. All such operators shall possess a current garage keeper's legal
liability insurance policy, which shall cover fire, theft and explosion
in a minimum amount of $75,000 and collision coverage of $10,000,
with a maximum deductible provision of not greater than $1,000. Said
policy shall insure that every accident insuring the operator shall
be deemed a separate claim.
B. The towing operator shall also provide a garage operator general
public liability policy covering the operation of the towing business
equipment in the amount of $500,000 and automobile bodily injury liability
and property damage in a minimum amount of $100,000 for any one injury
or accident and $300,000 for more than any one personal injury and
in any one accident.
C. In addition, the operator shall provide property damage coverage
in the minimum amount of $10,000 for any and all damages arising out
of injury or destruction to property.
D. All policies of insurance shall have a duplicate copy, and the duplicate
shall be furnished to the Township Clerk. Each policy shall contain
a specific endorsement providing notice to the Township of Knowlton
in the event of any change or cancellation. The garage operator or
towing service company shall provide a certificate of insurance or
an endorsement naming the Township of Knowlton as an additional insured
thereon and shall further provide a Hold Harmless and Indemnification
Agreement, by policy endorsement or separate document, in a form acceptable
to the Township.
All towing operators authorized under this chapter shall have
sufficient and approved storage area, within a reasonable distance
from the Township, to store not less than five towed vehicles. All
towing operators must maintain inside storage space for any vehicle
impounded by the New Jersey State Police to be used in any criminal
case and shall further provide outside storage facilities for other
towed vehicles, which shall be in a protected area approved by the
Township Committee.
No towing operator shall use any Township insignia, logo or
other identification and shall not possess or exhibit flashing lights
on any vehicle, except as provided in N.J.S.A. 39:1-1 et seq.
Each towing operator shall supply to the Township of Knowlton
a list of any and all equipment, either owned or leased, in its possession
for the adequate performance of municipal towing services. The equipment
available shall be capable of towing all types of motor vehicles,
including but not limited to trucks, trailers, automobiles, buses
and other motor vehicles capable of removal by towing. In the event
that any towing operator changes his equipment, the operator shall
be obligated to notify the Township, in writing, of any such change
in the amount of types of equipment that it may possess so that the
Township can determine whether or not the towing operator remains
qualified for municipal towing services.
All towing operators shall be available or on call on a weekly
basis to tow disabled motor vehicles on a rotating daily basis so
that each tower shall be available or on call for a twenty-four-hour
period. This twenty-four-hour on-call towing period shall be rotated
among all towing operators, as determined by the amount of the Township
approved operators. In the event that a towing operator refuses to
respond to a call within the on-call period, then, and in that event,
the towing operator shall be denied the right to be on call for the
next scheduled weekly period. Failure by the towing operator to respond
shall be excused when said failure is beyond the control of the operator
and said evidence is supplied to substantiate the failure to respond.
The Township Committee hereby designates the Knowlton Township
Committee as its agent to supervise and enforce the terms and provisions
of this chapter.
All fees to be paid to any towing operator by the Township of
Knowlton for the storage or removal of motor vehicles by the Township
shall not exceed the sum provided under N.J.S.A. 40:48-2.50.
Each operator shall be bound to comply with the separate specifications
for towing and storage of impounded motor vehicles for the Township
of Knowlton, which specifications set forth all particulars defining
and limiting said towing operations and defining the bidder's
qualifications, operators, employees obligations, removing and storing
of abandoned motor vehicles, charges for services, indemnification
and insurance, business records, inspections, contract period, awards
of contract, forms and other qualifications adopted by the Knowlton
Township Committee and which are specifically incorporated herein
by reference and adopted as a condition of this chapter and made a
part hereof without specifically including the text of the entire
specifications herein. Specifications for towing operators are available
from the Township Clerk and may be amended from time to time by the
Township Committee.
