Borough of Kinnelon, NJ: Application of provisions to semipublic areas.

§ 84-4.1 Application of provisions to semipublic areas.

Fayson Lake. The provisions of Subtitle 1, Title 39, of Revised Statutes of the State of New Jersey, shall be made applicable to semipublic and private roads, streets, driveways, trails and parking areas open to or used by the public, employees and members of Fayson Lake Association for the purpose of vehicular traffic, including but not limited to the parking area contiguous to the Fayson Lake beach, the roadway leading to Sabey's beach on West Lake and the parking area and roadway contiguous to the clubhouse.

Meadtown Shopping Center.

1483 Rt. 23, Meadtown Shopping Center. Pursuant to written consent of UB Kinnelon I, LLC, the provisions of Subtitle 1 of Title 39 of the New Jersey Statutes and, unless otherwise provided herein, all pertinent municipal ordinances are applicable to the semipublic roads, streets, driveways and parking lots at 1483 Rt 23 (Block 45301, Lot 101), located in the Borough of Kinnelon, County of Morris, as approved by Kinnelon Planning Board, Application No. 804, and the following regulations shall be enforceable:

(a)

This Subsection B shall only be effective with respect to that portion of the shopping center located within the jurisdiction of the Borough of Kinnelon; that is, Block 45301, Lot 101 on the Official Tax Map of the Borough of Kinnelon.

(b)

The Borough of Butler is hereby requested to adopt a companion ordinance to this one making Title 39, Subtitle 1 applicable to that portion of the Meadtown Shopping Center located in the Borough of Butler.

(2)

Parking.

(a)

All vehicles must park in designated areas/spaces and between the lines provided.

(b)

No person shall stop or stand a vehicle upon any of the streets or parts of streets described below in areas covered by other parking restrictions.

Handicapped parking. All stalls shall be 12 feet wide and signed with the R7-8 and R7-8P (reserved parking sign and penalty plate) in the designated parking areas for persons who have been issued handicapped parking permits by the Division of Motor Vehicles.

(d)

Time limit. Customer parking is limited to a maximum of three hours and no person shall stand or park any vehicle in excess of three hours without obtaining permission from one of the businesses in the Meadtown Shopping Center. Notice of these restrictions shall be posted at various locations within the parking area and such notice shall consist of signs not less than 18 inches by 24 inches upon which there shall be written words "three-hour parking for customers only."

Entrance and exits.

(a)

Entrance only. The locations described are hereby designated as entrance only.

Regulatory and warning signs shall be erected and maintained regarding the designated speed limits, which were authorized by the Department of Transportation.

(7)

Tow-away zones. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, pedestrian walkways, or present, in any way, a safety or traffic hazard, may be removed by towing the vehicle at the owner's or operator's expense.

(8)

Load zones. The locations described are hereby designated as loading zones. No person shall park a vehicle in said location during times indicated, other than for the loading or unloading of goods and materials.

All signs, posts, or other necessary material must be installed and paid for by UB Kinnelon I, LLC. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.

Violations and penalties. Unless another penalty is expressly provided for by New Jersey Statute, all municipal ordinances, including § 84-2, Violations and penalties, shall be fully applicable to the semipublic areas of 1483 Rt 23.

Smoke Rise of Kinnelon. Pursuant to the written consent of the Board of Governors of the Smoke Rise Community of Kinnelon, the provisions of Subtitle 1 of Title 39 of the New Jersey Statutes and, unless otherwise provided herein, all pertinent municipal ordinances are applicable to and enforceable within the premises commonly known as "Smoke Rise of Kinnelon" by virtue of the enactment of Ordinance 18-88 on November 17, 1988, and hereafter shall be made applicable with reference to specific semiprivate roads, streets, driveways and parking lots at Smoke Rise of Kinnelon as set forth in the report of the New Jersey Department of Transportation by letter dated December 15, 1992, and the following regulations shall be enforceable:

Parking spaces. Parking of all vehicles shall be limited to designated areas and within the lines provided.

(2)

Handicapped parking. Handicapped parking shall be provided in accordance with the pertinent site plan and shall be subject to applicable state and municipal ordinances; all stalls shall be 12 feet wide and signed with R7-8 (Reserved Parking Sign and Penalty Plate).

(3)

Through streets. The following streets or parts of streets are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting a through street, except where yield signs are provided for in the designation:

All signs, posts or other necessary materials shall be installed and paid for by the Smoke Rise Club. All work shall be subject to inspection by the Kinnelon Police Department to ensure that installations meet all state, federal and municipal regulations, and all signs shall conform to the current Manual on Uniform Traffic Control Devices.

(10)

Violations and penalties. Unless another penalty is expressly provided by New Jersey statutes, all municipal ordinances, including § 84-2 (Violations and penalties), shall be fully applicable to the semipublic areas of the Smoke Rise Club.

Kinnelon Mall. Pursuant to the written consent of Lester M. Entin Associates, the provisions of Subtitle 1 of Title 39 of the New Jersey Statutes Annotated and, unless otherwise provided herein, all pertinent municipal ordinances shall be made applicable to the semipublic roads, driveways and parking lots in the Kinnelon Mall as set forth on the Traffic Circulation and Signage Plan on Preliminary and Final Site Plan for Kinnelon Mall (Block 33, Lot 12), Sheet 8, prepared by Theodore Cassera of Kanger and Cassera, Parsippany, New Jersey, dated August 20, 1991, and the following regulations shall be enforceable:

Parking spaces. Parking of all vehicles shall be limited to designated areas and within the lines provided.

(2)

Handicapped parking. Handicapped parking shall be provided in accordance with said site plan and shall be subject to applicable state and municipal ordinances.

All municipal ordinances, including § 84-2, Violations and penalties, shall be fully applicable to the semipublic areas of Kinnelon Mall.

Partners, LP, the provisions of Subtitle 1 of Title 39 of the New Jersey statutes and, unless otherwise provided herein, all pertinent municipal ordinances shall be made applicable to the semiprivate roads, streets, driveways and parking lots at the Apple Montessori School as set forth in the report of the New Jersey Department of Transportation by letter dated May 5,1992, and the following regulations shall be enforceable:

Pursuant to the written consent of Lester Entin Associates, the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at the Columbia Savings Bank and Professional Offices located in the Borough of Kinnelon, County of Morris, and the following regulations shall be enforceable:

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

Kinnelon Ridge. Pursuant to the written consent of the Kinnelon Ridge Developers, LLC, the provisions of Subtitle 1 of Title 39 of the New Jersey Statutes and, unless otherwise provided herein, all pertinent municipal ordinances are applicable to the semipublic roads, streets, driveways and parking lots at Kinnelon Ridge located in the Borough of Kinnelon, County of Morris, as set forth in the report of the New Jersey Department of Transportation by letter dated October 28, 2004, and the following regulations shall be enforceable:

Pursuant to the written consent of Joseph Paterno, the provisions of Subtitle 1 of Title 39 of the New Jersey Statutes and, unless otherwise provided herein, all pertinent municipal ordinances are applicable to the semipublic roads, streets, driveways and parking lots at 2 Kiel Avenue, located in the Borough of Kinnelon, County of Morris, as set forth in the report of the New Jersey Department of Transportation by letter dated May 23, 2005, and the following regulations shall be enforceable:

Pursuant to the written consent of Kinnelon Route 23, LLC, the provisions of the Subtitle 1 of Title 39 of the New Jersey Statutes and, unless otherwise provided herein, all pertinent municipal ordinances are applicable to the semipublic roads, streets, driveways and parking lots at 1149 Route NJ 23 southbound located in the Borough of Kinnelon, County of Morris, as approved by Kinnelon Planning Board, application no. 817; and the following regulations shall be enforceable:

Tow-away zones. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exitways, loading zones, oil fills, any grassy area pedestrian walkway, or present, in any way, a safety or traffic hazard, may be removed by towing the vehicle at the owner's or operator's expense.

(6)

Loading zone(s). The locations described are hereby designated as loading zones. No person shall park a vehicle in said location during the times indicated, other than for the loading or unloading of goods and materials.
