1. The purposes of this Part are to:
A. Protect the air resources of the Borough of Beaver in order to:
(1)
Preserve the health, safety and well-being of Borough residents.
(2)
Prevent injury to plant and animal life and to property.
(3)
Promote the comfort and convenience of the general public.
(4)
Enhance the cleanliness and beauty of the community as a place
to live and work.
B. Regulate the disposal of garbage and other domestic refuse in a manner
consistent with environmental protection and public health concerns.
C. Restrict the production and emission of smoke, soot, fly ash, fumes
and other particulate and gaseous products of combustion within Borough
limits.
D. Regulate the setting of fires within the Borough.
E. Control the burning of refuse within the Borough in a manner consistent
with the provisions of the Air Pollution Control Act (Act No. 787
of 1959, as amended).

All outside burning by any commercial business is prohibited,
but this prohibition shall not apply to any incinerator or furnace
built within or constructed within a building, provided that the chimney
of that incinerator or furnace extends beyond the roof level 10 feet
higher than the highest adjoining building on the adjacent premises;
and provided further, that the chimney has a wire screen or other
top so constructed as to prevent fly ash from escaping.

1. Except as expressly permitted below, all outside burning of any material
is prohibited.
2. Charcoal, wood or gas fires kindled for the purpose of outside barbecues
are permitted.
3. Open fires may be set in the performance of official duties by any
police officer or fireman of the Borough of Beaver if such fire is
necessary for:
A. The prevention of a fire hazard which cannot be abated.
B. The protection of public health.
4. Campfire or ceremonial bonfires may be set, but only with prior approval
of the Chief of the Beaver Volunteer Fire Department as to location,
material, duration and required safety precautions.

Fireplaces and properly vented free-standing stoves within private
residences are permitted for the purposes of providing heat or aesthetic
enjoyment, but in no event shall garbage, rubbish or trash be burned
therein.

Any person, firm or corporation who shall violate any provision
of this Part shall, upon conviction thereof, be sentenced to pay a
fine of not more than $1,000; and/or to imprisonment for a term not
to exceed 90 days. Each day that a violation of this Part continues
shall constitute a separate offense.

1. The Beaver Volunteer Fire Department is authorized to engage in the
following ancillary activities in addition to those activities recognized
and designated under § 601(a)(1) of the Pennsylvania Workers'
Compensation Act [as amended, 77 P.S. § 1031(a)(i)]:
A. Perform inspection services of the Borough fire hydrants in accordance
with the manual developed and to be revised, from time to time, by
the Department, subject to Council approval.
B. Supervise and/or participate in the Beaver VFD 5K/10K Race to raise
funds for the purpose of providing training and equipment to the Department's
firefighters.
C. Run, help run, or otherwise assist in the management of the Beaver
County Women's Center race.
D. Participate in the Light up Festivities in Beaver Borough.
E. Attend and participate in parades as approved and authorized by the
Fire Chief.
F. Attend and participate in training and classes from outside providers
as approved and authorized by the Fire Chief.
G. Attend and participate in fire prevention programs in the Borough
or its immediately contiguous municipalities as approved and authorized
by the Fire Chief.
H. Coverage of Beaver Area School District events (such as football
games) as approved and authorized by the Fire Chief.
I. Any other activity which may from time to time be specifically authorized
by action of the Borough Council.

Under no circumstances is the Fire Department permitted to participate
in any ancillary activities where its members are serving, selling
or distributing alcoholic beverages.
