The purposes of this Part are to:
A. 
Safeguard public health, safety and general welfare.
B. 
Preserve the value of property within the Borough of Beaver.
C. 
Eliminate or reduce liability or insurance claims for personal injury or property damage from improper skateboarding activity.

1. 
The provisions of this Part shall be interpreted according to the following principles:
A. 
Words and phrases used in this Part which are defined in the Pennsylvania Vehicle Code (Act No. 81 of 1976, as amended) shall have the meanings there specified.[1]

B. 
Words and phrases used in this Part which are not specifically defined in § 6-703 shall have their common or ordinary meanings, as shown by a standard dictionary.

As used in this Part, the following words and phrases shall have the meanings specified:
BOROUGH
The Borough of Beaver.
OWNER
The person having legal title to a property.
PERSON
Any individual, partnership, corporation, association, institution, cooperative enterprise, government unit or agency, or any other legal entity which is recognized by law as the subject of rights and duties. In any provisions of the Part prescribing a fine, imprisonment or civil penalty, or any combination of the foregoing, the term "person" shall include the officers and directors of any corporation or other legal entity having officers and directors.
PROPERTY
Any lot or parcel of land within the Borough.
SKATEBOARD
A nonmotorized vehicle propelled by human power and/or gravity, consisting of a platform with wheels attached to the underside.
SKATEBOARDING
The use or operation of a skateboard as a conveyance or for recreation.

1. 
A person engaged in skateboarding shall at all times operate his or her skateboard in such a manner as is safe and prudent under the circumstances and conditions then existing and so as not to constitute a hazard to any person, property or vehicle.
2. 
A person engaged in skateboarding shall obey all traffic and pedestrian control signals as provided by the Pennsylvania Vehicle Code, § 3112 (relating to traffic control signals) and § 3113 (relating to pedestrian control signals).
3. 
A person engaged in skateboarding shall obey the instructions of a police officer or other person authorized to direct, control or regulate traffic.
4. 
A person engaged in skateboarding shall yield the right-of-way to any pedestrian.
5. 
A person engaged in skateboarding shall not suddenly leave a curb, sidewalk, berm of street or any other place of safety and ride upon or propel the skateboard into or toward the path of a vehicle which is so close as to constitute a hazard. Where there are no pedalcycle lanes, a person engaged in skateboarding upon a roadway shall ride as near to the right of the roadway as practical, exercising due care when passing a standing vehicle or a vehicle proceeding in the same direction.
6. 
When traveling on a roadway, a person riding a skateboard shall comply with all rules and regulations applicable to other vehicles using that roadway.

1. 
It is unlawful for any person to:
A. 
Engage in skateboarding upon the sidewalks along Third Street between Insurance Street on the west and Beaver Street on the east.
B. 
Engage in skateboarding on any property where such activity is prohibited or restricted by a posted sign.
C. 
Engage in skateboarding on private property without the prior written consent of its owner.
D. 
Engage in skateboarding at any time or place in a manner contrary to the regulations set forth in § 6-704 above.
E. 
Place a ramp, half-pipe or other structure intended for skateboarding on any street or sidewalk open to vehicular or pedestrian passage.

1. 
Any person who violates this Part shall be guilty of a summary offense.
2. 
Any person convicted of violating this Part shall be sentenced to pay a fine of not less than $25 nor more than $300, plus the costs of prosecution.
