Borough of Beaver, PA TRAFFIC REGULATIONS

The following speed limits are hereby established:

	Street	Between	Speed Limit
	Third Street	Commerce Street and Sassafras Lane	35 mph
	All borough streets except the portion of Third Street listed above	Entire extent	25 mph

Any person who shall operate a vehicle at a speed in excess of that established therefor, upon any highway or portion thereof as specified in this section, shall, upon conviction thereof, be sentenced to pay a fine of $35 and, for exceeding a maximum speed limit by more than five miles per hour, shall pay an additional fine of $2 for each mile per hour in excess of five miles per hour over the maximum speed limit.

§ 15-202 Traffic Signals at Certain Intersections.

At the following intersections, official traffic signals shall be erected (or are hereby ratified if heretofore erected), and traffic at such intersections shall be directed by such signals:

§ 15-203 Right Turn on Red Signal Prohibited at Certain Intersection.

It shall be unlawful for the driver of any vehicle traveling on the first-named street at any of the following intersections, in the direction or directions hereby indicated in each case, to make a right turn when his or her vehicle is facing a steady red traffic signal:

§ 15-204 Stop Intersections.

The following intersections are hereby established as stop intersections, and official stop signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named street upon the first-named street, in the direction or directions hereby indicated. It shall be unlawful for all vehicles approaching any such intersection upon the first-named street, in the direction or directions hereby indicated, to not come to a full stop, within a reasonable distance, before entering any such intersection:

§ 15-205 Yield Intersections.

The following intersections are hereby established as yield right-of-way intersections, and official yield signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named street upon the first-named street. All vehicles approaching any such intersection upon the first-named streets shall yield the right-of-way to any vehicle in the intersection or approaching on the second-named street so closely as to constitute an immediate hazard during the time that the driver of such vehicle is moving across or within such intersection:

§ 15-206 Through Streets Established.

The following streets are hereby established as through streets, and the driver of every vehicle upon approaching any such street at any intersection thereof (except for intersections where there are now or shall hereafter be located official traffic control signals) shall come to a full stop, within a reasonable distance before entering any such through street:

These streets are under control of the Commonwealth of Pennsylvania as to speed and weight restriction and are not under the Borough speed or weight regulations.

Any driver of a vehicle who shall violate any provision of this section, shall upon conviction thereof, be sentenced to pay a fine of $25, together with costs of prosecution.

§ 15-207 One-Way Streets.

§ 15-208 Turning at Certain Intersections Prohibited or Restricted.

It shall be unlawful of the driver of any vehicle, traveling upon the first-named street at any intersection named in this section, in the direction or directions indicated in each case, to make a left turn and/or a right turn into the second-named street, except as specifically permitted in this section.

§ 15-209 Intersections Where Right Lane Only Must Be Used for Right Turn or Proceeding Across Intersection.

It shall be unlawful for the driver of any vehicle, traveling upon the first-named street at any of those intersections, to make a right turn or to proceed directly across the intersection otherwise from the right lane:

§ 15-210 Gross Weight Limits Established.

A gross weight limit of 7 1/2 tons is established upon all streets of the Borough, except upon the following streets which are state-maintained roads:

S.R. 68, being Third Street in said Borough, extending from the Bridgewater Borough line on the east to the Vanport Township line on the west S.R. 4018, being that portion of Market Street extending northwardly from the north line of Third Street to Brighton Township line S.R. 4028 and S.R. 4051, being that portion of Buffalo Street extending northwardly from the north line of Third Street to Brighton Township line

To which legislative routes, streets or portions thereof said weight limit shall not apply:

Provided that said weight limit shall not apply to any street, or portion thereof, unless and until standard, state-approved signs setting forth the weight limit shall have been erected at the limits of said streets and at the intersection thereof with any of the above-listed state-maintained roads.

Provided further that said weight limit shall not apply to any type of vehicle making deliveries to or picking up goods, wares or merchandise from property located upon any street upon which a weight limitation is imposed, nor shall said weight limit apply to operation of any vehicle where a special permit shall have been issued by the Chief of Police to operate such vehicle regardless of weight.

Provided further that the above limitation shall not apply to vehicles, trucks or truck-tractors hauling food, household goods, garbage or rubbish, building materials nor to public utility vehicles, fire-fighting equipment or to school or public transportation buses or vehicles.

Any person who violates this section is guilty of a summary offense and, upon conviction, shall be sentenced to pay a fine of $75, plus $75 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the specified weight limit. In the event such fine is not applicable, any person who violates this section shall be sentenced to pay a fine of not less than $300 nor more than $600, plus all costs of prosecution, or, in default of payment, to undergo imprisonment for not less than 10 nor more than 30 days.

§ 15-211 Engine Brake Retarder Equipment.

Definition. As used in this section, the term engine brake retarder equipment shall mean compression release engine braking systems used on gasoline-powered or diesel engines.

Purpose. The Council of the Borough of Beaver has determined that the use of engine brake retarder equipment creates excessive noise, and is otherwise detrimental to public health, safety and welfare, and is therefore declared a public nuisance.

Prohibition. The use of engine brake retarder equipment is hereby prohibited on Third Street (State Route 68) between the western boundary line of the Borough near Sassafras Lane and Wilson Avenue on the east.

Exception. This prohibition shall not apply to emergency vehicles while responding to an emergency, nor any vehicle in time of imminent danger or distress.

Signage. The Borough shall provide public notice of this prohibition by erecting and maintaining signage in accordance with applicable regulations of the Pennsylvania Department of Transportation.

Penalty. Any person who violates this section, or who causes or permits such violation, shall upon conviction before a magisterial district judge be sentenced to pay a fine of not less than $100 nor more than $500 and costs of prosecution.
