Parking meters installed in the parking meter zones established by § 470-30 of this chapter shall be placed upon the sidewalk and immediately adjacent to the individual parking spaces described in Ordinance 9-1978, November 6, 1978, as amended by Ordinance 4-1987. Each parking meter shall be placed or set so as to show that the parking space adjacent to that meter is or is not legally occupied. Each parking meter installed shall indicate by a proper legend the maximum legal parking time established by the Borough for parking at that meter and, when occupied, shall indicate on it, in a manner as prescribed by the type of meter installed, the period of legal parking time remaining and, upon the expiration of that period, shall identify, in a manner consistent with the type of parking meter installed, that either no time is remaining (and vehicle is illegally parked) or that the vehicle parked in said location is in violation and illegally parked.
It shall be unlawful for any person to park a vehicle or to allow a vehicle to remain parked in a parking meter zone for longer than the maximum legal parking time established by the Borough for parking at the meter where the vehicle is parked or without having deposited the proper coin or coins, as required by § 470-34 of this article at any time: a) between 8:00 a.m. and 6:00 p.m. on any Tuesday, Wednesday or Friday; or b) between 8:00 a.m. and 9:00 p.m. on any Monday, Thursday or Saturday, provided that these parking time limits and the requirement to deposit a coin in a meter shall not apply on any Sunday or legal holiday.
Lines and/or markings shall be painted or placed upon the curb, sidewalk and/or roadway adjacent to each parking meter for the purpose of delineating the parking space for which that meter is to be used. Each vehicle parked at any meter shall be parked wholly within the lines or markings so placed and applicable to that meter. It shall be unlawful and a violation of this article for any person to park a vehicle across any such line or marking or to park a vehicle in such a position that vehicle is not wholly within the area so designated by those lines or markings.
Whenever a vehicle is to be parked in any space adjacent to a parking meter at any time during the period of limited parking as prescribed in § 470-32 of this article, the driver of the vehicle, upon entering that parking space, shall immediately deposit or cause to be deposited in any parking meter one or more proper coins of the United States of America as specified on the legend on the parking meter. Upon the deposit of the coin or coins in the meter, and upon placing the meter in operation, if the meter is a manually operated meter, the parking space may be lawfully occupied by the vehicle for the time designated on the meter as the duration of legal parking as determined by the coin deposit. If any vehicle shall remain in any such parking space for such length of time that the meter shall indicate by proper signal that the lawful parking time has expired, that vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this article.
It shall be unlawful and a violation of this article for any person to permit a vehicle to remain in any parking space adjacent to a parking meter when that meter displays a signal indicating that the vehicle has already been parked beyond the period of time prescribed for that parking space or beyond the period of time for which legal parking was permitted for the coin or coins deposited by or for that person when the vehicle was parked in that space.
It shall be unlawful and a violation of this article for any person to deface, tamper with, open or wilfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article, provided that nothing in this section shall apply to the servicing or opening of parking meters by officers, employees or police officers of the Borough under the direction of the Mayor and/or Borough Council.
The Chief of Police, under the direction of the Mayor, may temporarily have hoods placed over specific parking meters to accommodate funerals, heavy loading and unloading operations, and other special needs or emergencies. It shall be unlawful and a violation of this article for any person to park a vehicle or to allow a vehicle to remain parked in a parking space adjacent to a hooded meter, except for a vehicle for the convenience of which the hood has been placed.

A. 
It shall be the duty of the police officers and parking enforcement personnel of the Borough, acting in accordance with the directions of the Chief of Police, to report:
(1) 
The number of each parking meter that indicates that the vehicle occupying the adjacent parking space is, or has been, parked in violation of any provision of Ordinance No. 9-1978, November 6, 1978, as amended.
(2) 
The date and hour of the violation.
(3) 
The state and license number of the vehicle.
(4) 
Any other facts, the knowledge of which is necessary for a thorough understanding of the circumstances attending the violation.
B. 
Any such police officer and other person making the report shall also place on the vehicle a notice which shall be identified as a "parking ticket," which shall give notice to the owner or operator of the vehicle that the vehicle was parked in violation of the provisions of this article and instructing the owner or operator that the penalty requirements shall be as follows:
(1) 
Within one hour after the time of the notice, deposit the sum of $3 in a depository or receptacle called a "courtesy box" placed for the purpose or pay the sum of $3 at the Borough Police Station or to the office of the Borough Secretary of the Borough of Vandergrift or, within the time limitation prescribed, pay by regular United States Mail, postage prepaid, the fine, submitting the same to the Borough of Vandergrift to the address indicated on the ticket, which said ticket shall be provided in a self-mailer with the violator to be responsible for all costs of postage; or
(2) 
Within 48 hours after the time of the notice, deposit the sum of $5 in a depository or receptacle called a "courtesy box" placed for the purpose or pay the sum of $5 at the Borough Police Station or to the office of the Borough Secretary of the Borough of Vandergrift or, within the time limitation prescribed, pay by regular United States Mail, postage prepaid, the fine, submitting the same to the Borough of Vandergrift to the address indicated on the ticket, which said ticket shall be provided in a self-mailer with the violator to be responsible for all costs of postage.
(3) 
If not paid sooner, upon the expiration of the fifth calendar day from the date of the issuance of the notice, the Borough shall send, by regular United States Mail, postage prepaid, an official police notice card providing for payment of a late fine/penalty in the amount of $10.
(4) 
If payment is not rendered within 10 calendar days from the date of the mailing of the official police notice card referenced in Subsection B(3) above, the original notice/parking ticket shall be referred to the Magisterial District Judge which serves the Borough of Vandergrift for criminal prosecution, with all fines and costs of prosecution to be lawfully assessed by a court of competent jurisdiction.

A. 
Any person who violates any provision of this article, with the exception of § 470-38, shall for each and every violation, upon conviction, be sentenced to pay a fine of not less than $5 and not more than $15 and costs, provided that, in the case of a penalty for overtime parking, each additional hour during which parking time limits apply under this article that a vehicle remains in an individual parking space after the prescribed time for parking has elapsed shall be deemed an additional violation.
B. 
Any person who violates any provision of § 470-38 of this article shall, upon conviction, be sentenced to pay a fine of not more than $100 and costs of prosecution and, in default of payment of fine and costs, to imprisonment for not more than 10 days.

The following areas are hereby established as on-street permit parking areas as so designated and authorized by the Council of the Borough of Vandergrift:

B. 
Fee established. The fee for an on-street metered parking permit shall be $10 per month, payable in advance, with a minimum of 12 months due and owing. The fee may be amended from time to time hereinafter by the Borough Council of the Borough of Vandergrift by resolution. All amounts paid shall be nonrefundable for any reason.
C. 
Conditions for use. Courtesy parking spaces in the commercial area as identified in this section may be established by any person or persons or business entity as a courtesy parking space for the business and commercial area only. The meters may be courtesy permitted by meter number but shall not be exclusive to or for the lessee. The permitted metered area shall be for the benefit of the entire commercial district and all the merchants generally and may be used by any person or persons for a period not to exceed one hour and shall be nonexclusive in nature. The courtesy metered parking spaces shall be considered courtesy only when they are appropriately bagged and only during normal business hours for the merchant who has purchased the courtesy permit. At all other times, regular meter rates and penalties for illegal parking therein shall apply. The individual, person or persons or merchant that purchases the courtesy space shall be responsible to cover the meter utilizing a courtesy meter bag. When not covered, the meter shall be treated as any other parking meter in the Borough of Vandergrift and shall be subject to the provisions that apply to regular metered parking spaces in the Borough of Vandergrift.

The following are hereby established as designated areas for resident nonexclusive permit parking areas as authorized and operated by the Borough of Vandergrift:

B. 
Nonexclusive provisions. No resident may reserve any specific designated parking metered area as an exclusive reserved parking meter for permit parking. A resident may purchase a permit for parking at any meter in the area so indicated by this section but at no time shall a resident designate a metered parking space as a reserved meter parking space exclusively for the benefit of the lessee.
C. 
Fees. A resident permit for on-street metered parking spaces shall be $2 per month with a minimum of a six-month period to be paid in advance, and all said amounts shall be nonrefundable. Upon payment of the fees as established in this section for an on-street metered parking permit, a resident shall be presented with a method of vehicle designation which must be visible on or in the vehicle utilizing a metered parking space in the designated area. The fee herein may be amended from time to time hereafter by resolution of the Borough of Vandergrift.
