The Administrator shall be appointed for an indefinite term by a majority of all members of Council. The Administrator shall serve at the pleasure of the Council and may be removed at any time by a majority vote of all its members. At least 30 days before such removal is to become effective, the Council shall furnish the Administrator with a written statement setting forth its intention.

1. 
The Administrator shall be chosen solely on the basis of executive and administrative abilities, with special reference to the duties of the office as herein outlined.
2. 
The requirements shall include a Bachelor's degree from an accredited college in public or business administration, or equivalent experience in municipal financial administration, planning, organizing, and directing administrative services.
3. 
The Administrator need not be a resident of the Borough or of the Commonwealth of Pennsylvania at the time of appointment, but during the tenure of office, must move into the Commonwealth within a reasonable period of time, to be determined by the Council.

Before entering upon his duties, the Administrator shall give a bond to the Borough with a bonding company as surety, to be approved by the Council, in a sum to be determined by Council, conditioned upon the faithful performance of his or her duties, the premium for said bond to be paid by the Borough.

1. 
The Administrator shall be the chief administrative officer of the Borough and shall be responsible to the Council as a whole for the proper and efficient administration of the affairs of the Borough placed in his or her charge. The powers and duties of administration of all Borough business shall be vested in the Administrator, unless expressly imposed or conferred by statute or ordinance upon other Borough Officers.
2. 
Subject to recall by ordinance of Council, the powers and duties of the Borough Administrator shall include the following:
A. 
Administer all ordinances of the Borough of Ben Avon.
B. 
Be responsible to Council for carrying out all policies established by it and for the proper administration of all affairs of the Borough within the jurisdiction of the Council.
C. 
Appoint and/or remove, with consent of Council, an administrative assistant.
D. 
Appoint, suspend, or remove any municipal employee, except as otherwise provided by law, or contract. The Borough Administrator may retain independent contractors with the consent of Council. Salaries and fees are to be fixed within the range set by Council.
E. 
Direct and supervise the administration of all departments, offices and agencies, except as otherwise provided by law, or contract.
F. 
Prepare and administer the personnel system of the Borough of Ben Avon.
G. 
Prepare and submit the annual budget and capital program to the Council under the provisions established by Council, and administer the budget and capital program adopted by the Council.
H. 
Make such recommendations to the Council concerning policy formulation as the Administrator deems desirable, and keep all members of Council regularly informed as to the conduct of Borough affairs.
I. 
Keep the Council fully advised as to the financial condition of the Borough and make such financial reports as Council may desire.
J. 
Insure that all terms and conditions imposed in favor of the Borough or its inhabitants in any statute, public utility franchise or other contract are faithfully kept and performed, and upon knowledge of any violation, call the same to the attention of Council.
K. 
Attend all Council meetings and have the right to take part in discussions.
L. 
Perform all duties of the Borough Secretary under the Borough Code, 53 P.S. § 45101 et seq., and all Borough ordinances. Prepare agenda and record minutes of Council meetings. Prepare ordinances and resolutions for Council action; maintain the minute book and other official records, and have custody of the Borough seal.
M. 
Take an annual inventory of all Borough supplies and equipment. A detailed report of the inventory noting any variations between the recorded and actual quantities shall be submitted to Council.
N. 
Plan, supervise, and coordinate the work of the Building Inspector, Zoning Officer, and Fire Marshall. Appraise the soundness of building and zoning ordinances and make recommendations for changes governing zoning, building inspection, health inspection, fire prevention and safety.
O. 
Develop and implement a procedure for the collection of various taxes or other fees and delinquencies owed the Borough as directed by Council.
P. 
Develop and maintain an effective procedure for the pursuit and acquisition of funding through various county, state, and federal grant programs, in addition to any non-governmental funding that may be available. Report to Council as requested relative to such pursuits.
Q. 
Supervise Borough employees and develop annual performance review with a copy of these reported to Council.
R. 
Insure the timely and accurate payment of municipal bills and collection of monies owed.
S. 
Develop a program to fully utilize the Borough computer by identifying and utilizing available software.
T. 
Perform other such work as the Council shall require. The Borough reserves the right at any time by ordinance to amend or otherwise modify or repeal this Part in any particular.

The Mayor is hereby authorized to delegate in writing to the Borough Administrator, subject to revocation by written notification at any time, any non-legislative and non-judicial powers and duties.

It is the intent of Council that neither the Council, its members, nor its committees shall dictate or influence the hiring of any persons to, or discharge from, municipal employment by the Administrator, or in any manner take part in this hiring, suspending or discharging of employees in the administrative service of the Borough except as required by the civil service provisions of the Borough Code, 53 P.S. § 45101 et seq. Other than for the purposes of inquiry the Council or any of its members or any of Council's committees or its members should deal with the administrative service solely through the Borough Administrator and neither the Council nor any of its members, nor any of Council's committees or its members, should give orders — publicly or privately — to any subordinate of the Administrator.

If the Administrator becomes ill or needs to be absent from the Borough, Council shall designate one qualified member of the staff to perform the duties of the Administrator during such absence or disability.

The present practice of electing three Borough Auditors is abolished and such incumbent elected Borough Auditors, for and during the remainder of their elected terms, if any, shall serve without duties or remuneration.

Commencing with the borough's 1973 fiscal Year, and annually thereafter, the Borough Council of the Borough of Ben Avon shall appoint an independent Borough Auditor who shall be a certified public accountant, registered in Pennsylvania, a firm of certified public accountants so registered or a competent public accountant or a competent firm of public accountants who shall perform his duties as required by law at such remuneration as is agreed to by the Borough Council of the Borough of Ben Avon.
