Any owner of property abutting upon any street or streets of
the Borough having a sidewalk reservation of 12 feet or more, is hereby
authorized to plant along the front of such property shade trees of
the following descriptions, viz., Elm, Maple, Horse Chestnut or Pin
Oak, provided that each of such trees shall be planted in the center
of the grass plot existing between the curb and the footwalk constructed
upon such street, and that a distance of 25 feet shall be preserved
between each two trees so planted, respect being had to trees, if
any, on adjoining properties, in determining such separating distances.

All shade trees growing within the lines of any street in the
Borough shall be kept trimmed by the property owners in front of whose
property such trees are growing, in such manner that no limb or limbs
shall be at a less height than eight feet from the sidewalk. It shall
be the duty of the Public Works Director, to notify such property
owner of any such infraction hereof, and upon a failure for 10 days
by such property owner to have such trees properly trimmed, the Public
Works Director is hereby authorized to have said tree or trees properly
trimmed in accordance herewith, the cost of the same to be charged
to such property owner, said cost to be collectible by law within
30 days after rendering a bill for the same.

It shall be unlawful for any person or persons to break, bruise
or cut, except as herein provided, or otherwise authorized by Council,
any shade tree or trees growing within the lines of the streets of
the Borough, upon conviction thereof, shall be sentenced to a fine
of not less than $5 nor more than $1,000 plus costs and, in default
of payment of said fine and costs, to a term of imprisonment not to
exceed 30 days. Each day that a violation of this Part continues or
each section of this Part which shall be found to have been violated
shall constitute a separate offense.

or each section of this Part which shall be found to have been violated
