A person commits the offense of littering if he or she places,
deposits, or causes to be placed or deposited, any glass, glass bottles,
wire, nails, tacks, hedge, cans, garbage, trash, refuse, or rubbish
of any kind, nature or description on the right-of-way of any public
road or State highway or on or in any of the waters in this City or
on the banks of any stream, or on any land or water owned, operated
or leased by the State, any board, department, agency or commission
thereof or on any land or water owned, operated or leased by the Federal
Government or the City, or on any private real property owned by another
without the owner's consent.

A. Bonfire Or Rubbish Fire Regulations.
1.
No person shall kindle or maintain any bonfire or rubbish fire
or authorize any such fire to be kindled or maintained on any private
land unless the location is not less than thirty (30) feet from any
structure and adequate provision is made to prevent fire from spreading
to within thirty (30) feet of any structure, or;
2.
The fire is contained in a waste burner located safely not less
than fifteen (15) feet from any structure.

No person, except a duly authorized representative of the City,
shall kindle or maintain any bonfire or rubbish fire or authorize
such fire to be kindled or maintained on public land, other than designated
park areas. This Section shall include City streets and road right-of-way
adjacent to streets.
B. Bonfires and rubbish fire shall be constantly attended by a competent
person until such fire is extinguished. This person shall have a garden
hose connected to the water supply, or other fire extinguishing equipment
readily available for use.
C. The Board of Aldermen, City Engineer, or their duly named representative
may prohibit any or all bonfires and outdoor rubbish fires when atmospheric
conditions or local circumstances make such fires hazardous.
D. No person shall kindle a fire upon the land of another without permission
of the owner thereof or his agent.
E. Upon conviction, any person or persons violating any provision of
this Section shall be fined an amount not less than five dollars ($5.00),
nor more than two hundred dollars ($200.00) for each offense.
