A. 
All persons owning any lot, tract, or parcel of land in the City abutting upon any street in which any trees are growing adjacent to any sidewalk, or growing upon such street and adjacent to such lot, tract or parcel of land on which there is no such sidewalk, shall be required to trim such trees as hereinafter provided.
B. 
All trees shall be kept trimmed in a manner and form as follows: All trees five (5) inches in diameter and not greater than eight (8) inches in diameter shall be trimmed to a height that all leaf-bearing limbs shall not at the outer end thereof hang nearer the ground than twelve (12) feet when said limbs are not laden with rain, snow or sleet, or fruit; all trees greater than eight (8) inches in diameter shall be trimmed to a height that all leaf-bearing limbs shall not at the outer end thereof hang nearer the ground than fourteen (14) feet when said limbs are not laden with rain, snow, sleet or fruit; and all trees less than five (5) inches in diameter shall be trimmed and kept trimmed in such manner and form as not to interfere with the travel on the street either by pedestrian or vehicle.
C. 
Whenever any tree or trees in the City shall need trimming so as to meet the requirements of this Section, the Committee on Streets, Alleys and Sidewalks shall cause a notice in writing to be served on the owner of the property adjacent to and abutting on the street where such trees are growing, requiring said trees be trimmed to meet the requirements of this Section, which said notice may be served by the Street Commissioner by delivering a copy of said notice to the owner or his/her tenant residing on the property or by leaving a copy of such notice at the usual place of abode of such owner with some member of his/her family over the age of fifteen (15) years.
D. 
Any person failing or refusing to comply with the provision of this Section within thirty (30) days after service of notice as provided in Subsection (C) of this Section shall, upon conviction, be adjudged guilty of an ordinance violation and shall be punished by a fine as set out in Section 100.220 of this Code.
