A certain document, three copies of which are on file in the office of the Borough Secretary of the Borough of Forty Fort, being marked and designated as the International Property Maintenance Code, 2006 edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Forty Fort, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and, the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefore; and, each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this Part, with the additions, insertions, deletions and changes, prescribed in § 5-302 of this Part.

All successive editions of the International Property Maintenance Code, as published by the International Code Council, shall replace the previous edition, with consideration to the revisions under § 5-302.

Nothing in this Part or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or in any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 5-303 of this Part; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part.

The Borough shall adopt, establish and implement an annual Fire and Safety Inspection Program of all commercial, educational and institutional properties operating within the Borough. Any building containing three or more dwelling or sleeping units shall be included in this program. The owner of said properties shall be required to obtain an annual certificate of occupancy. Certificates of occupancy shall be issued by the Code Enforcement Officer only after inspection and acceptance of the property by the Borough Code Enforcement Officer and/or Fire Code Official, or designee.
2. 
Pursuant to the Fire and Safety Inspection Program, each commercial property, and each rental unit stated above, shall be subject to inspection of the following:
A. 
Proper use in accordance with occupancy use classification.
B. 
Cooking hood fire protection system.
C. 
Portable extinguishers.
D. 
Fire protection systems, including stand pipes and sprinkler systems.
E. 
Fire, smoke and safety alarms.
F. 
Emergency power systems.
G. 
Exit and emergency area lighting.
H. 
Storage of hazardous and nonhazardous materials.
I. 
Stacking and storage of combustible materials.
J. 
Exit/emergency egress doors.
K. 
Records of evacuation plans, fire drills.
L. 
Records of fire protection and alarm system tests.
M. 
Anti-backflow device test records.

Other items required by the Pennsylvania Uniform Construction Code, 35 P.S. § 7210.101 et seq., or NFPA to be periodically tested and/or inspected shall be included. Items added by subsequent revisions to the codes are hereby automatically incorporated into this program without amendment to this Part.

Owners of said properties shall make arrangements with the Borough to obtain inspections and certificates of occupancy beginning January 1, 2007. Certificates of occupancy must be obtained by April 1, 2007. Certificates of occupancy must be obtained by April 1 of each subsequent year.

Any violation discovered during inspection shall require the inspecting official to give written notice to the property owner, or designated responsible party, stating all violations, and to give the property owner 30 days' notice to correct, abate, repair or otherwise remove the violations. If the violations are not corrected, abated, repaired or removed within the thirty-day period, the property owner shall be subject to fine, penalty, ceasing operations within and closing of the property, or other enforcement action. If violations are not corrected, abated, repaired or removed within 30 days and a citation is issued by the Borough, the property owner shall be, upon conviction thereof, sentenced to a fine of not less that $300 nor more than $1,000 for each and every day the violation continues in existence, in addition to other remedies or courses of action taken by the Borough.
6. 
Annual fees for inspections and certificates of occupancy shall be in amounts as established from time to time by resolution of Borough Council.
