This Part shall be known, and may be cited as the "Code Enforcement Ordinance of the Borough of Renovo."

There is hereby created by the Council of the Borough of Renovo an Office of Code Enforcement. Said office shall have the responsibility of administering the applicable codes and ordinances of the Borough. These codes include: the Building Code, the Electrical Code, the Fire Prevention Code, the Housing/Property Maintenance Code, and the Plumbing Code [Chapter 5] of the Borough of Renovo. The Office of Code Enforcement shall also enforce provisions of other ordinances, as specified.

Borough Council shall appoint a Code Enforcement Officer to be in charge of the Office of Code Enforcement.

The Code Enforcement Officer shall have had at least five years building experience as a professional engineer or architect, Building Inspector, contractor or superintendent of building construction, and such other qualifications as may be determined by Council. The Code Enforcement Officer shall not hold any other position which conflicts with his official duties or with the interest of the Office of Code Enforcement.

The duties of the Code Enforcement Officer shall include the receipt of applications, the issuance of permits, notices, certificates and orders, and the making of inspections, to determine conformance with the applicable codes and ordinances. The Code Enforcement Officer shall also be required to do research, make investigations, establish appropriate rules, keep records, issue reports when required, and perform other activities as necessary, and shall, when necessary, recommend to Council the employment of technical inspectors, whose qualifications and compensation shall be determined by Council.

The Code Enforcement Officer shall make a monthly report to Council which shall contain all proceedings under the codes adopted by the Borough. These reports shall contain such other information as Council may request. The Code Enforcement Officer shall also make recommendations as to the amendments of the applicable codes and ordinances.

In the discharge of the duties of the office, the Code Enforcement Officer or authorized representative shall, when showing proper identification, have the authority to enter, at any reasonable hour, any structure or premises in the Borough of Renovo to enforce the provisions of the applicable codes and ordinances.

The owner of a building, structure or premises, or any person aggrieved by a decision of the Code Enforcement Officer, shall have the right to appeal such decision. Appeals shall be made to Borough Council, which shall act as the Board of Appeals as established under the various codes.

A person desiring to make an appeal shall notify the Borough Secretary in writing that a hearing before Council is desired. The Borough Secretary shall, within 15 days, notify the person so appealing as to the time and place of the hearing.
3. 
All hearings shall be public, and the appellant, his or her representative, the Code Enforcement Officer and any other person whose interests may be affected shall be given the opportunity to be heard.
4. 
A majority of Council members then in office shall constitute a quorum, and a hearing may take place. In case there is no quorum, another meeting shall be scheduled.
5. 
A simple majority of members voting shall serve to affirm, modify or reverse the decision of the Code Enforcement Officer. In the case of a tie vote, the Mayor shall cast the deciding vote.
6. 
The Code Enforcement Officer shall take immediate action in accordance with the decision of Council. Any person dissatisfied with a decision of Council may make further appeal as provided by law.

The owner of a building or structure or his agent who has been served with an unsafe order and notice to make such structure safe, secure or habitable, or to take down and remove such structure, shall have the right to appeal to the Board of Survey. Such Board of Survey shall consist of three persons, to be appointed by Council, to have such qualifications as Council may determine.
2. 
It shall be the duty of the Board of Survey to inspect the building or structure, and to confirm, modify or revoke the order of the Code Enforcement Officer or his assistant, as may seem proper for the maintenance of peace, good government, safety and welfare of the inhabitants of the Borough.

The findings and determinations of any two members of the Board shall be deemed conclusive, and copies of the report shall be filed with the Code Enforcement Officer, with the Borough Secretary, and with the owner of the building or structure or his representative.
