A. No
person owning or responsible for a dog shall permit the dog to defecate
on any public property or right-of-way or on any private property
other than property owned or leased by the person owning or responsible
for the dog.
B. It
is a specific defense to a charge of violating this Section that the
person charged immediately removed the excrement and properly disposed
of it in a sanitary manner.
C. Any person convicted of a violation of Section
210.2420 shall be subject to a fine, if combined with the amount of court costs, totaling not more than two hundred dollars ($200.00) for the first violation. If multiple violations are committed within a twelve-month period, not more than two hundred seventy-five dollars ($275.00) for the second violation, not more than three hundred fifty dollars ($350.00) for the third violation, and not more than four hundred fifty dollars ($450.00) for the fourth violation and any subsequent violation.
