Any person, firm, corporation, or other entity that violates
or permits the violation of any provision of this Part shall be subject
to a civil penalty in the amount of $600. A separate offense shall
arise for each day or portion thereof that a violation exists and/or
for each section of the Part violated. When the penalty imposed for
violation of this Part is not voluntarily paid to the Township within
30 days of receipt of a written demand for payment or such longer
time frame agreed to in writing by the Township, the Township may
initiate a civil enforcement proceeding before a magisterial district
judge, in accordance with the Pennsylvania Second Class Township Code,
in which case the violator shall be liable for the penalty imposed,
including daily penalties for continuing violations, plus court costs,
and reasonable attorney's fees incurred by the Township. The
Township shall be exempt from the payment of costs in any civil case
brought to enforce this Part. In addition to or in lieu of civil actions
before a magisterial district judge, the Township may enforce this
Part in an action in equity brought in the Bucks County Court of Common
Pleas.
