This Part shall be titled the "Canton Township Parks and Recreation
Board Ordinance."

There is hereby created a Park and Recreation Board known as
the "Canton Township Park and Recreation Board" ("Board") to facilitate
the creation and operation of a public recreation program and to assist
in the development of recreation facilities.

1. The Board shall be composed of five voting members, to be appointed
by the Canton Township Supervisors, with the power to provide and
conduct recreation and cultural activities and maintain public recreation
areas, facilities, and centers to all responsibilities of the recreation
enabling legislation. The Board members shall serve for a term of
five years and until their successors are appointed except that the
members first appointed shall be so appointed that the term of one
member shall expire annually thereafter. Vacancies shall be filled
in the same manner as original appointments and for the unexpired
term. Members shall serve without pay.
2. In addition to the five voting members, a group of volunteer/trainee
members of such number as may be determined as beneficial to the Park
and Recreation Board in its conducting of activities and programs
is hereby authorized. It is the intent of the Supervisors that Board
members serve as a volunteer/trainee member for a minimum of six months
experience prior to being appointed as voting members.

1. All of the members of the Park and Recreation Board shall be residents
of Canton Township, Washington County, Pennsylvania, at the time of
appointment and for the term of the appointment.
2. Canton Township recognizes the importance of Park and Recreation
Board members having Act 34 and 151 clearance(s). Therefore, it will
reimburse members of the Park and Recreation Board for any fees paid
by any member to secure said clearance(s) upon receipt by the member
of said clearance(s).

Any member of the Park and Recreation Board, once qualified
and appointed, may be removed from office for malfeasance, misfeasance
or nonfeasance in office for the failure of voting members to participate
in more than three consecutive business meetings or for other just
cause by a majority vote of the Board of Supervisors aforesaid taken
after the member has received 15 days' advance notice of the
intent to take such a vote. A hearing shall be held in connection
with the vote if the member shall request it in writing. Any appointment
to fill a vacancy created by removal shall be only for the unexpired
term.

1. The Park and Recreation Board shall elect its own Chairman and Vice
Chairman and create and fill such other offices as it may determine.
Officers shall serve annual terms and may succeed themselves. The
Park and Recreation Board may make and alter bylaws and rules and
regulations to govern its procedures consistent with the ordinances
of Canton Township and the laws of the Commonwealth of Pennsylvania.
All by-laws, rules and regulations must be approved by the Canton
Township Board of Supervisors.
2. The Park and Recreation Board may make recommendations to the Township
Supervisors concerning the operation and conduct of the recreational
programs conducted by the Park and Recreation Board. The Supervisors
shall review the same and may make resolutions or ordinances concerning
them. (See Res. 5-2008 as an example).

The Park and Recreation Board shall advise the Township Board
of Supervisors on how to maintain, equip and operate parks and other
recreational facilities; develop a program of recreation activities
and services designed to meet the various leisure time interests of
all residents; evaluate programs, facilities, services and relationships
periodically to assure that the Township's goals and objectives
are being achieved; review and advise the Township Board of Supervisors
of proposed recreation plans and facilities in connection with land
development activities and plans; and advise and assist in the development
and acquisition of adequate financial support for park and recreation
facilities and programs.

1. The Board of Supervisors may appropriate funds on an annual basis
to support activities of the Board. Expenditures recommended by the
Park and Recreation Board shall be on forms provided by the Township,
and shall conform to the Township budget, as well as appropriate Township
ordinances and resolutions and state and federal laws governing purchasing
and expenditures.
2. The Park and Recreation Board shall have no authority to enter into
any contract or incur any obligation binding upon Canton Township,
other than current obligations or contracts to be fully executed within
the then current fiscal year, and all within the budget appropriations
made by the Board of Supervisors of Canton Township.
3. Should a prospective donor desire to donate funds or in-kind services
with an actual or estimated value in excess of $1,000, an agreement
form (Exhibit A) must be prepared and executed between the donor and
the Township Supervisors before the donation can be accepted.

Funds appropriated by the Board of Supervisors of Canton Township
and budgeted to the Park and Recreation Board, shall be disbursed
by the Secretary/Treasurer of Canton Township upon vouchers issued
by the Park and Recreation Board within the budget appropriations
made and subject to the approval of the Township Supervisors. Funds
received by the Park and Recreation Board from sources other than
budget appropriations shall be deposited by the Park and Recreation
Board in a Canton Township bank account to the credit and for the
use of the said Board, and disbursed as the above budget funds are
disbursed, except that funds received by gift, bequest, or otherwise
shall be disbursed in accordance with the terms of the acceptance
thereof.

The Board shall keep a full record of its business and shall
annually make a written report by April 1 of each year of its activities
to said Board of Supervisors. Interim reports may be made as often
as may be necessary or as requested by the Board of Supervisors. The
fiscal year of said Park and Recreation Board shall conform to that
of Canton Township.

Such powers that are now or may hereafter be provided by statute
of the Commonwealth of Pennsylvania, or by ordinances of Canton Township
relating to the development and operation of recreation systems, public
parks, and playgrounds, are hereby vested in the Park and Recreation
Board, to be exercised by it subject to any and all restrictions contained
in such powers and ordinances.
