This chapter is intended to modify the provisions of § 23
of the Town Law and § 3 of the Public Officer's Law
or any other provision of law requiring a person to be a resident
of the political subdivision or municipal corporation of the state
for which he or she shall be chosen or within which his or her official
functions are required to be exercised so that the duly appointed
Code Enforcement Officer of the Town of Urbana may reside in a town
in Steuben County or in any New York State county adjacent to Steuben
County.
The provisions of § 23 of the Town Law and § 3
of the Public Officers Law or any other provision of law requiring
a person to be a resident of a political subdivision or municipal
corporation of the state for which he or she shall be chosen or within
which his or her official functions are required to be exercised are
waived to the extent that such provisions shall not prevent persons
duly appointed as Code Enforcement Officers in the Town of Urbana
from serving as Code Enforcement Officers in the Town of Urbana, so
long as all other qualifications contained in § 23 of the
Town Law and § 3 of the Public Officers Law are satisfied
by the appointee to each such office.
