There is hereby continued in and for the County of Dutchess, a County Legislature which shall be the elective governing body of the County of Dutchess and shall, when lawfully conveyed, constitute the legislative body of the County of Dutchess and which shall have all the powers, rights, duties and obligations conferred upon it by the laws of the State of New York and the Charter and Administrative Code of the County of Dutchess. All incumbent members of the Dutchess County Legislature shall continue to serve until December 31, 2013, unless such incumbent's service shall be terminated by death, resignation, special election, or otherwise, in which event such vacancy shall be filled in the manner herein provided.

County Legislators shall be elected at general elections, in odd-numbered years, from such districts and in such numbers from each district as hereinafter provided, with the first election hereunder to be held at the general election in the year 2013. The term of office of all County Legislators shall be two years, dating from January 1 of the next year following their election.
County Legislators at the time of their official nomination for election, such nominations to be made in accordance with the proper and applicable sections of the Election Law of the State of New York, shall be electors of the County of Dutchess qualified to vote in general elections from the districts they seek to represent. They shall continuously thereafter while seeking or holding such office be residents of the districts from which they are nominated or elected. The Board of Elections of the County of Dutchess shall be the judge of the above qualifications of the members of the County Legislature and, for that purpose, shall have the power to subpoena witnesses, take testimony, and require the production of records. Decisions made by the Board of Elections in the exercise of the powers granted by this section shall be subject to review by the courts.

For the purpose of electing County Legislators in such numbers and from such districts as provided herein, the County of Dutchess shall be divided into 25 districts. The total number of County Legislators elected shall be 25, there being one County Legislator elected from each such district. County legislative districts are described below in terms of municipal jurisdiction, wards, election districts, census blocks, boundaries, roads, streams and other landmarks in existence on March 24, 2011, as depicted on official United States Census Block Maps filed with the Dutchess County Department of Planning and Development.

A. 
If the legislative districts created as a result of this redistricting plan do not carry out the purposes thereof because of unintentional omission; duplications; overlapping areas; erroneous nomenclature; lack of adequate maps or descriptions of political subdivisions, or other divisions thereof, or of their boundary lines; street closings, changes in names of streets, or other changes of public places; alteration of the boundary or courses of waters or waterways, filling in or lands under water, accretion or other changes in shorelines; alteration of courses, rights-of-way, or lines of public utilities or other conditions; or an inaccuracy in the United States Census Bureau Topologically Integrated Geographic Encoding and Referencing system (TIGER geography files) or demographic data, then the Dutchess County Legislature, at the request of any person aggrieved thereby, any candidate affected thereby, or by its own initiative, is hereby authorized by resolution to correct such technical defects in the description of the legislative districts so as to accomplish the purposes and objectives of this adopted redistricting plan.
B. 
In making such technical corrections, the Legislature, in addition to achieving equality in the population of legislative districts and ensuring that all areas of the County are completely and accurately encompassed in such districts, shall be guided by the following standards:
(1) 
Gaps in the description of any legislative district shall be completed in a manner that results in a total description of that district consonant with the description of adjacent districts and in complete contiguity of districts.
(2) 
Areas of the County included within the descriptions of more than one legislative district shall be allocated to the district having the lowest population.
(3) 
Areas of the County not included with the descriptions of any legislative district shall be allocated to the adjacent district having the lowest population.
(4) 
In the event that the area subject to corrected description or allocation as provided in Subsection B(1), (2) or (3) is of such size or contains such population that its inclusion as a unit in any legislative district would result in substantial disparity in the size, shape or population of such district, then the Legislature may allocate portions of such area to two or more districts.
(5) 
In making adjustments to the boundary line of a legislative district in the event of an inaccuracy in the TIGER files, the Legislature shall, whenever possible, implement the apparent geographical intent of the United States Census Bureau.
(6) 
In any allocation of area or correction of descriptions made pursuant to this section, the Legislature shall, consistent with the foregoing standards, preserve the contiguity and compactness of legislative districts and avoid the unnecessary division of political subdivisions.
Vacancies which occur on the County Legislature shall be filled in the following manner:
A. 
Within 30 days after a vacancy occurs:
(1) 
In districts wholly within the City of Poughkeepsie, by a majority vote of the whole membership of the Common Council.
(2) 
In districts wholly within the City of Beacon, by a majority vote of the whole City Council.
(3) 
In districts wholly within a town, by a majority vote of the whole membership of the Town Board of said town.
(4) 
In multiple-town districts and/or city districts, by a majority vote of the whole membership of the Town(s) Board and/or City Council composing said district assembled collectively for the purpose of filling such vacancy.
B. 
If the vacancy is not filled within 30 days pursuant to the provisions of Subsection A hereof, it shall be filled in the manner prescribed in the County Law or other applicable law.
C. 
The candidate selected in the manner provided in this section shall take and file his/her oath of office in accordance with law and shall take his/her seat at the next meeting of the County Legislature, and shall serve until December 31 following the next general election, at which time the electors of the district shall elect a district representative to complete the balance of the term if any.
