Sex Offender Registration Act — See Correction
Law Art. 6-C, § 168 et seq.
The purpose of this chapter is to provide local law enforcement
with additional information about Level 3 sex offenders. This is critical
to preventing sexual victimization and resolving incidents involving
sexual abuse and exploitation promptly. The Sex Offender Verification
Form will equip local law enforcement with the necessary tools to
alert the public when necessary for the continued safety and protection
of the community and will provide a means to penalize those Level
3 sex offenders who intentionally mislead a public servant by providing
false statements in the Sex Offender Verification Form.
This chapter is hereby adopted as set forth herein and shall
be entitled the "Sex Offender Verification Law."
This chapter shall apply to Level 3 sex offenders as classified
in accordance with New York Correction Law Article 6-C, the Sex Offender
Registration Act.
As used in this chapter, the following terms shall have the
meanings indicated:
A Level 3 sex offender who is required to personally verify
his or her address with the local law enforcement agency every 90
days pursuant to § 168-f of the New York State Correction
Law.
A.
In conjunction with the required ninety-day personal verification,
a sex offender shall complete a "Sex Offender Verification Form."
The sex offender shall provide current information, including residential
address, work address, telephone numbers (home, work, mobile), mode
of transportation, vehicles regularly driven, manner of internet access,
internet service provider, e-mail addresses and screen names.
B.
The form shall be submitted under oath, with the sex offender verifying
that the statements made therein are true. The form shall be filed
and recorded with the local police agency with whom the sex offender
completes his or her regular ninety-day verification.
A.
Failure or refusal to file. A sex offender who fails or refuses to
file the Sex Offender Verification Form, including changes to the
form, with the appropriate law enforcement agencies in Dutchess County
within the time periods provided for herein shall be guilty of a Class
A misdemeanor.
B.
False statements made in sex offender verification form. Any false
statements made in the Sex Offender Verification Form signed by the
sex offender shall be punishable pursuant to the Correction Law and
the New York State Penal Law.
