Any owner of real property in the Borough who agrees to transfer
title to or a leasehold interest in, or grant the right to occupy,
all or a portion of such property to another for residential purposes
shall, within 10 days after making such an agreement, notify the Borough
Manager of the agreement, providing a copy of the agreement if it
is in writing and the names of all transferees, lessees and grantees.
The notice shall provide the address and telephone number of any owner,
lessee, transferee or grantee. Each change in or addition to the list
of transferees, lessees or grantees shall require a new and complete
notice. This notice may accompany, but is in addition to, any request
by such owner or on the owner's behalf for a no lien certificate
in connection with such transfer or grant.
Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not less than $25 nor more than $1,000,
plus court costs and reasonable attorneys' fees incurred by the Borough
in the enforcement proceedings. Upon judgment against any person by
summary conviction, or by proceedings by summons on default of the
payment of the fine or penalty imposed and the costs, the defendant
may be sentenced and committed to the Allegheny County correctional
facility for a period not exceeding 30 days. Each day that such violation
exists shall constitute a separate offense, and each section of this
article that is violated shall also constitute a separate offense.
In addition to or in lieu of enforcement under this section, the Borough
may enforce this article in equity in the Court of Common Pleas of
Allegheny County.
