A. Any Peace Officer of the City of Salisbury that is
certified pursuant to Chapter 590, RSMo., shall have the authority
to respond to emergency situations outside the boundaries of the City.
B. The City of Salisbury, Missouri, does, through this
Section, adopt all of the provisions set forth in Section 70.820,
RSMo., as the official policy of the City and does authorize the Chief
of Police to authorize responses to emergency situations as defined
in said Statute.
C. This Section shall be effective when a political subdivision
has passed a similar ordinance, order or other ruling as set forth
in Section 70.820, RSMo.
D. As used in Section 70.820, RSMo., "emergency situation"
means any situation in which the Law Enforcement Officer has reasonable
belief that a crime is about to be committed, is being committed,
or has been committed involving injury or threat of injury to any
person, property, or governmental interest and such officer's response
is reasonably necessary to prevent or end such emergency situation
or mitigate the likelihood of injury involved in such emergency situation.
The determination of the existence of any emergency situation shall
be at the discretion of the officer making the response.
E. As used in this Section, "response" shall mean to
take any and all action which the officer may lawfully take as if
exercising his or her normal police powers within his or her own jurisdiction.
F. This Section does not effect previously established
mutual assistance agreements between this City and other Cities and
Counties of the State of Missouri.
