On May 27, 2015, the Lancaster Area Sewer Authority ("LASA") purchased Columbia Municipal Authority and the Borough's wastewater collection and transportation system assets. In accordance with that transaction, the Rules and Regulations of LASA (as amended, the "LASA Rules and Regulations") are incorporated by reference into this Chapter 173 and attached hereto as Appendix A.[1] If there is any conflict between the LASA Rules and Regulations and this Chapter 173 or with any other provision of the Borough Code, then the LASA Rules and Regulations shall control and supersede such conflicting provision. If there is any dispute over whether such a conflict exists and how it is resolved, the opinion of the Executive Director of LASA shall be final and binding on LASA, the Borough and any third party.
Notwithstanding the preceding Subsection, the incorporation of Chapter 60, Industrial Waste, and Chapter 165, Trucked Waste, is incorporated herein contemporaneously with the point in time that LASA notifies the Borough that the "startup of the transportation facilities" has occurred (as such term is defined in the Bulk Treatment During Construction Service Agreement dated May 27, 2015, between the Borough and LASA).
