The Township of Upper Nazareth hereby agrees to intergovernmentally
cooperate with the Association of Municipal Subdivisions consisting
of the Township of Bushkill, Lower Nazareth, and Upper Nazareth, and
the Boroughs of Nazareth, Bath, Stockertown, and Tatamy, and the Nazareth
Area School District known as the Nazareth Area Council of Governments.
No function, power, or responsibility of the Township will be exercised
through intergovernmental cooperation with other member municipalities
unless ratified by resolution of the Board of Supervisors of the Township.

The Township hereby agrees to participate in the Nazareth Area
Council of Governments for a term commencing with the adoption of
this Part.

The Township shall enter into an agreement entitled Articles
of Agreement, a copy of which is attached hereto and incorporated
herein by reference,[1] with the intent and effect that the Township shall be
bound by the agreement.

The Chairman of the Board of Supervisors and Secretary are hereby
authorized and directed on behalf of the Township to execute and deliver
the agreement.

The Board of Supervisors of Upper Nazareth Township is hereby
authorized to take such other action as may be necessary or appropriate
to carry out the purposes of this Part and said Articles of Agreement.

The purpose of the Nazareth Area Council of Governments is to
meet at regular intervals to foster a cooperative effort to resolve
regional problems, to determine policies, and to formulate plans and
programs to meet regional needs. Additional purposes shall include:
communication and coordination, policies and priorities, community
facilities and services, forum, regional spokesman, staff support,
and regional review. The Board of Supervisors of the Township hereby
pledges its support of such purposes and further agrees to jointly
cooperate in the exercise or in the performance of its respective
governmental functions, powers, and responsibilities. This pledge
of intergovernmental cooperation without further amendment to the
within Part shall not be construed as to delegate or transfer any
functions, powers or responsibilities to another local government
or to the Nazareth Area Council of Governments.

The Township pledges such expenditures as shall be required
under the Articles of Agreement.

The Nazareth Area Council of Governments shall in all respects
conform with the requirements of the Intergovernmental Cooperation
Act, 53 Pa.C.S.A. § 2301 et seq., and the School Code, 24
P.S. § 5-522.
