1. It shall be the duty of every owner of lots or real estate, and they
are hereby enjoined and required, previous to the construction or
erection of any building setting or resetting of curbs, to make application
to the Township Secretary to cause the line and grade for the setting
of curbs to be fixed by the Township Engineer.
A. Exemption from the requirements of all or any part of this Part may
be granted by the Supervisors of the Township at a regular meeting
of the Board, upon appeal, if in the opinion of the Supervisors, no
purpose would be served by strict compliance with the provisions of
this Part.

1. The Township Engineer, upon receipt of the written order of the Township
Secretary and upon ascertaining that the applicant's property stakes
are in position, shall fix the line and grade for the setting or resetting
of curbs and shall give to the owner of such property, or contractor,
or mechanic, a certificate of such survey, line, and grade, which
certificate shall be sufficient authority for such owner, contractor
or mechanic, to commence and complete the work as may be described
in the certificate and in accordance with the directions therein contained.
The Township Engineer shall likewise enter the survey line or grade
so given by him in a record book of survey kept by him for that purpose,
which book shall remain in the office of the Township Secretary.
A. This grade shall be given only once at Township expense. If for any
reason the grade or the presence of the engineer is required thereafter,
the property owner or applicant will be required to pay the engineers
charges for same.

1. The foundation for all concrete curbs shall be formed and thoroughly
compacted to a firm even surface in both cut and fill areas prior
to placing any and all forms. Foundation areas subject to compaction
shall be areas within 24 inches of proposed face and back of curb
measured at right angles from said curb. All unsuitable materials
shall be removed and replaced with acceptable material.
2. In fill areas, the foundation shall be brought up to a grade of not
less than 10 inches below and parallel with the finished surface of
the proposed curbs. Fill materials shall be spread and compacted in
even layers not more than four inches thick.
3. In excavated areas, where rock is encountered, rock shall be removed
to a depth of two inches below bottom of proposed curb and crushed
stone, gravel or other suitable material shall be placed to form a
workable even base.
4. Prior to placing any concrete, all lines and grades on curb forms
shall be checked and approved by the Township Engineer. Vertical and
horizontal control points when established by persons other than the
Township Engineer, including ties or references to proposed or existing
rights-of-way, easements, and/or other pertinent data shall be supplied
to the Township Engineer to expedite checking of aforesaid forms.
5. All materials, workmanship and/or tolerances where applicable shall
conform to the specifications as described in PennDOT Form 408 unless
otherwise expressly stated in this Part.

1. All curbs placed on any public street in the Township, Northampton
County, Pennsylvania, shall be subject to the approval of the Township
Engineer, and constructed of the following materials, in conformity
with a schematic diagram, prepared by the Township Engineer, and entitled
"Township Standard Curb Detail," dated February 25, 1965, to Drawing
# UN66-1 in the following manner:
A. Cement. All cement used shall be American Portland Cement of a well
known and tried brand, and of such quality as to fulfill the requirements
of the standard tests of the American Society for Testing Materials.
B. Sand. The sand used in concrete shall be clean, hard, and not too
fine. It shall not contain more than 5% of loam, clay, dirt or other
impurities; and shall consist of grains grades from coarse to fine,
passing a 1/4-inch mesh screen.
C. Stone. The stone used in concrete shall be crushed limestone, granite,
trap or other suitable hard stone in graded sizes from 1/2 inch to
1 1/2 inches in the largest dimension. Approved crushed gravel
not less than 60% of which shall have fractured edges may be substituted
for stone. Care shall be taken that the stone or gravel as used is
mixed as to size. All stone or gravel must be screened and shall be
subject to the approval and acceptance of the Township Engineer.
D. Concrete.
(1)
Concrete shall be composed of one part Portland cement, two
parts sand and four parts crushed stone or gravel. These proportions
shall be determined by volume measurement and all proportions of concrete
shall be done by means of a carefully gauged wheelbarrow or other
apparatus of capacity which shall be determined by the Township Engineer.
(2)
The mixing of concrete shall be done by an approved batch mixer
or ready mix concrete can be used. The quantity of water used shall
be sufficient to make the mass plastic, but not so wet as to cause
the mortar to separate from the stone. Concrete shall be placed in
position immediately after mixing and shall not be mixed in larger
quantities than is required for immediate use. Concrete that has developed
initial set shall not be retempered or used in any way.
E. Concrete Curb.
(1)
The concrete curb shall be six inches in width at the top, eight
inches in width at the base, and 24 inches in depth, on all streets.
It shall be carefully built to lines and grades established and approved
by the Township Engineer, in uniform lengths or blocks of not more
than 10 feet. These blocks are to be separated during the construction
by sheet metal templates 1/8 inch in thickness which are to be removed
after the concrete has developed initial set. Care must be taken to
insure having all templates set perpendicular between the length of
blocks and to have all exposed faces smoothly finished, conforming
to the lines and grades given. After the foundation is prepared, proper
forms and templates for the curbing shall be securely set to the lines
and grades indicated. The plank used for forms shall be dressed on
the edges and on the side set next to the concrete, and so securely
set, as to allow for the thorough spading and ramming of concrete
without displacing the forms. The front face of the curb shall be
battered and edged to a 3/4-inch radius and the rear rounded to a
1/4-inch radius. The concrete, conforming to the requirements as indicated
in these specifications, shall be placed in the forms as herein described.
(2)
The forms must be removed within 24 hours after the placing
of concrete and the exposed surface rubbed down or floated to a smooth,
even surface. If any holes or defects develop, they shall be filled
with mortar composed of one part cement and two parts sand and then
floated with a wooden float to a smooth, even surface.
(3)
When curb is completed, no further work on the street shall
be done until the curbing has been approved by the Township Engineer
to insure compliance with the provisions hereof.
F. Placing Concrete. After the subgrade and foundation has been prepared,
the concrete, conforming to these specifications, shall be laid or
placed in the forms and thoroughly tamped and spaded, to insure the
filling of all voids and to secure a concrete of maximum density with
all corners, full and square. All concrete must be finished with a
wooden float and true to the lines and grades given.

No building permit shall be issued by the Township Secretary
unless the property owner demonstrates an intention to carry out the
provisions of this Part. Further, no "occupancy permit" shall be issued
by the Zoning Administrator until the provisions of this Part have
been complied with. However, said occupancy permit may be issued by
the Zoning Administrator upon the property owner filing bond with
the Township Secretary which bond will insure compliance with the
provisions of this Part and shall be for an amount of 150% of the
estimated cost of curb construction and shall specify that said curb
shall be completed within six months of the issuance of the said occupancy
permit.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
