There shall be established and maintained on all property devoted
to or open to the public use one or more unobstructed fire lanes to
provide for ingress and egress of fire department vehicles, equipment
and personnel. Said fire lane shall be at least 12 feet in width,
extend the length of the improvement and/or building which is devoted
to or open to the public use, and be laid out for convenient access
from the public thoroughfares and water supplies to the building or
buildings. The marking of said fire lanes and their maintenance shall
be at the expense of the property owner or occupier. The plans for
said fire lanes and any signs to be erected may be requested by the
Police Department of Carroll Township and any signs to be erected
shall be designated and approved by the Board of Supervisors.
When a fire lane has been established according to § 359-22 above, the Chief of Police or his designee shall inform the property owner or occupant of their responsibility to mark and maintain the fire lane or portion thereof. Once such notification has been made, the owner or occupant shall mark and maintain said fire lane or portion thereof. The owner of occupant shall mark a fire lane or portion thereof within 30 days of receiving such notification. Each day past the 30 days that the owner or occupant fails to mark said fire lane or portion thereof shall constitute a separate and distinct violation. An owner or occupant shall maintain such markings once in place. Each day that the owner or occupant fails to maintain such marking shall constitute a separate and distinct offense.
No person shall park, stop or stand any motor vehicle in any
fire lane or portion thereof, nor shall any owner of said vehicle
permit same. No person shall obstruct a fire lane or any portion thereof
in any other manner or by any other means.
If there are any fire hydrants on said private property devoted
to or open to the public use or at any other location, parking, stopping
or standing may be restricted in the vicinity of fire hydrants in
accordance with requests of the Police Department of Carroll Township.
The posting of any such restrictions shall be approved by the Board
of Supervisors. When so marked, no person shall stop, stand or park
a motor vehicle at or near a fire hydrant, nor shall any owner of
said vehicle permit same. Notwithstanding the above, no person shall
park or leave unattended any motor vehicle within 15 feet of a fire
hydrant, even if no signs or markings prohibiting same are displayed.
Any member of the Police Department of Carroll Township may,
at any time, cause to be removed any obstruction or any motor vehicle
parked, stopped or standing in a fire lane or in violation of the
restricted area around a fire hydrant, and such removal shall be at
the expense of the person responsible for the obstruction.
A.Â
In any public parking area maintained by Carroll Township, the Chief
of Police may cause to be designated, by appropriate signs, parking
spaces specifically reserved for use by vehicles operated by or transporting
handicapped persons.
B.Â
In any privately owned parking area which is held open for parking
to the public within Carroll Township, the owner or person in control
thereof may, by the erection of appropriate signs, reserve certain
parking spaces for use by vehicles operated by or transporting handicapped
person.
C.Â
At the request of any handicapped person or disabled veteran, Carroll
Township may erect on the highway as close as possible to their place
of residence a sign or signs indicating that place is reserved for
a handicapped person or disabled veteran, that no parking is allowed
there by another, and that any unauthorized person parking there shall
be subject to a fine.
A.Â
The vehicles entitled to occupy the parking spaces reserved pursuant to § 359-28A, B and C above shall be:
(1)Â
Any vehicle bearing a handicapped registration plate, as provided
by § 1338 of the Pennsylvania Vehicle Code (75 Pa.C.S.A.
§ 1338), when occupied by the person to whom or on behalf
of whom such plate has been issued.
(2)Â
Any vehicle bearing a disabled veteran registration plate, as provided
by § 1342 of the Pennsylvania Vehicle Code (75 Pa.C.S.A.
§ 1342), when occupied by the disabled veteran to whom such
registration plate has been issued.
(3)Â
Any other vehicle when occupied by a person who is entitled to receive
a handicapped or disabled veteran registration plate under the Pennsylvania
Vehicle Code.
(4)Â
Any other vehicle when occupied by a person who has a currently valid
handicapped parking placard or any like form issued by the Pennsylvania
Department of Transportation or the like agency of any other state
or local government.
