The State Legislature has amended General Municipal Law § 103
to permit a municipality to award purchase contracts on the basis
of best value rather than only to the lowest responsible bidder. Section
103(1) of the General Municipal Law requires that the use of the best
value method for awarding a purchase contract must be authorized by
local law. The purpose of this article is to establish such authorization.
In awarding purchase contracts (including contracts for service
work, but excluding any purchase contracts necessary for the completion
of public works contracts pursuant to Article 8 of the Labor Law),
the Town Board hereby authorizes that such purchase contracts may
be awarded on the basis of best value as defined in § 163
of the State Finance Law and such other methods as provided in § 103
of the General Municipal Law.
