A. Open
burning will be permitted in the City of Dearborn, Missouri, at any
location within the City limits, under the following conditions or
parameters:
1. It shall be unlawful to burn or cause to burn any items other than
leaves, small twigs and small tree branches not to exceed four (4)
inches in diameter.
2. It shall be unlawful to burn any building materials. Building materials
shall include, but not limited to tires, rubber products, asbestos
containing material, hazardous materials, Styrofoam, plastics, petroleum
based products, treated wood, electrical wire, household trash and
other similar refuse.
3. It shall be unlawful to conduct any burn on a day in which the National
Weather Service issues a Red Flag Warning.
4. Burning shall be permitted only between the hours of 7:00 a.m. and
7:00 p.m., all burns shall be extinguished by 7:00 p.m.
5. No burning of any kind shall be allowed in any public street.
6. No burning of yard waste shall be permitted if the waste is in excess
of one (100) cubic feet, i.e., five (5) feet by five (5) feet by four
(4) feet, or in a metal barrel/drum of not larger the fifty-five (55)
gallon liquid or a five (5) feet by five (5) by four (4) feet burn
pit or a commercial burn pit that can be purchased.
7. An adult, over the age of eighteen (18) years, must always be present
during any burn until such time as the burn has been extinguished.
There must also be present a way to extinguish such fire if necessary,
i.e., fire extinguisher, garden hose or bucket of water.
8. It shall be unlawful to burn under any electrical, telephone, cable
lines or burn so near to them as to be a danger to such lines.
9. It shall be unlawful to conduct any burn within twenty-five (25)
feet of any structure, motor vehicle or combustible material.
10. It shall be unlawful to burn, when it is offensive or objectionable
due to smoke or odor emissions, when atmospheric conditions or local
circumstances make such burn hazardous to the general public or is
deemed to be dangerous in the opinion of any officer in the performance
of duties for the City of Dearborn. The burn may be required or caused
to be extinguished immediately as directed by a representative of
the City of Dearborn.
