A. No
person shall possess lighted smoking materials in any form, including,
but not limited to, the possession of lighted cigarettes, cigars,
pipes or other tobacco products in any public areas or waiting rooms
of City Hall; or any rooms in which meetings and/or hearings open
to the public are held or any area within the premises of the City
Hall building.
B. Any
person found guilty of violating this policy shall be subject to a
fine of not less than fifty dollars ($50.00) and not more than three
hundred dollars ($300.00) per incident.

No person shall deposit refuse, garbage, trash, rubbish, debris,
of any nature, including without limitation food waste, rejected vegetable
matter, paper, clothing, grass, leaves, tin cans, bottles or solid
waste of any nature whatsoever into any trash receptacle, dumpster
or other trash storage container not owned or leased by said person
without the authorization of the owner or lessee thereof.

A. Refuse Burning Restrictions. No person may conduct, cause,
permit or allow open burning of refuse.
B. Prohibition Of Salvage Operations By Open Burning. No person
may conduct, cause, permit or allow a salvage operation by open burning.
C. Restriction On Open Burning Of Trade Wastes. No person may
conduct, cause, permit or allow the disposal of trade wastes by open
burning.
D. Exceptions. Only tree trunks, tree limbs or other natural
vegetation (including leaves and lawn clippings) which is generated
on the person's property, may be burned subject to the following conditions:

1. The open burning will take place at a time of day when atmospheric
conditions will permit adequate dispersion of smoke.
2. City of Fair Grove which has jurisdiction approves the method and
site of open burning. Citizens may contact the City of Fair Grove
for a permit prior to burning. A permit may be issued for open burning
if weather is permitting. Citizens may request a permit by calling
the City of Fair Grove with the time, date, and location of the burn.
Three (3) full days advance notice will be required before permit
is issued for burning.
3. All burning shall take place on the owner's property. No burning
shall be permitted on the City's rights-of-way.
4. Any open burning shall be constantly attended until the fire is extinguished.
Fire extinguishing equipment shall be available for immediate use.
E. This
regulation shall not apply to the following:
1. Fires set in connection with agricultural operations related to the
growing or harvesting of crops.
2. Fires set for the purpose of instructing and training Firemen in
the methods of fighting fires.
3. Fires used for recreational purposes or fires used for the preparation
of food, such as by barbecuing.
F. Is
shall be prima facie evidence that the person(s) who owns or controls
the property on which open burning occurs, has caused or permitted
said open burning.

A. Definitions. For the purposes of this Section the following
terms shall be deemed to have the meanings indicated below:
CONSUMER FIREWORKS
Explosive devices designed primarily to produce visible or
audible effects by combustion and includes aerial devices and ground
devices, all of which are classified as fireworks, UNO336, within
49 CFR Part 172.
DISPLAY FIREWORKS
Explosive devices designed primarily to produce visible or
audible effects by combustion, deflagration or detonation. This term
includes devices containing more than two (2) grains (130 mg) of explosive
composition intended for public display. These devices are classified
as fireworks, UN0333 or UN0334 or UNO335, within 49 CFR Part 172.
B. Discharge Of Fireworks. It shall be unlawful for any person
to explode, detonate, discharge or combust fireworks within the City
limits between the hours of 10:30 P.M. to 10:30 A.M. except the weekend
before and after the fourth (4th) day of July and on July fourth (4th)
it shall be lawful to explode, detonate and discharge or combust fireworks
between the hours of 10:30 A.M. to 11:30 P.M. within the City limits.
C. Permit For Public Display Of Fireworks. Any person and or
organization that wishes to explode, detonate, discharge or combust
fireworks and or special fireworks within the City limits for exhibition
purposes at fairs, celebrations, concerts or other public affairs,
must obtain a permit from the City Clerk, which specifies that date,
time, particular location and individuals authorized to use fireworks
for such public display purposes. If the City Clerk grants a permit
to use fireworks for public display purposes, the individuals in charge
of same shall be experienced in the handling of fireworks and the
public attending the exhibition shall be at a safe distance and kept
there. Fireworks held in storage for the exhibition shall be kept
in a locked storage until they are removed for firing.
D. Seizure. When any person is found within the City limits
to be in violation of the provisions of this Section, the fireworks
may be seized and the City may dispose of or otherwise destroy such
fireworks.

It shall be unlawful for any person to throw away or place any
garbage, refuse or trash of any sort in or upon the streets, sidewalks
or public places or upon vacant lots or premises not his/her own within
the City.

It shall be unlawful for any person to conduct into any street
or other public place or upon any vacant lot, from any kitchen, house
or other structure or premises, any filth or unclean water or other
liquid or suffer such filth or unclean water or other liquid to escape
into any public place or upon any vacant lot, building or other structure
of whatever character, in a condition unsafe, dangerous, unhealthy,
injurious or annoying to the public.
